Multiple NOC Code (2174 and 2171)

Hi Friends,

I am a newbie to this group. I am applying for the CEC PR application. I have been in Canada for almost last 3 years on Closed Work Permit (NOC 2174 from Mar 2011 - May 2013 and on NOC 2171 from May until present). I am planning to apply PR under NOC 2171 as it matches the current duties as well as the current Work Permit. Also the letter i would receive from Company would show the total experience (2011-2013) and the responsibilities that matches the new NOC code (2171). There wouldn't be a seperation of position/duties within the duration for each NOC code (due to company policies). However I have included 2 NOC codes in the PR application (specifically in the Schedule 8 - Economic Class Application form) to match with 2 Work Permits.

Whether any one have gone through the same kind of scenario. Below are my concerns. Appreciate if any one can help me.

1. Does CIC will say that the letter provided by company contains only the duties for new NOC code (2171) that too for the whole duration (2011 - 2014) and this doesn't match with 2 Work Permits received from CIC (NOC 2174 from Mar 2011 - May 2013 and on NOC 2171 from May until present)?

2. Does CIC will say that you don't have 12 months experience in new NOC code (2171) or applied under a wrong NOC code (Considering 12 months experience is in 2174 vs 2171)

Is there any additional document that i should provide to make my case strong for the PR

As you've correctly noted, you fill out Schedule 8 with the (skilled) positions you have had, and the duration and NOC code for each one. In your case, NOC codes 2171 and 2174.

But earlier you say that you are "planning to apply under NOC 2171". I'm not sure what you mean by "applying under" a NOC code. There is no place in the CEC application where you're compelled to pick a single NOC.

Anyway, you'll want to convince your company to waive their policy and give you the two separate letters. Failing that, I suppose you could claim the experience for just the NOC 2174 period, as this would still get you over the 12 month mark.

Since you are on close wp, you are restricted to work on that occupation only. As you noted that your entire period matches 2171 as the employer letter specified, to me it would raise red flag that you were not authorized to work under 2171 until May 2013 as you were given a wp as 2174 in that period.

The safe way is what LPS suggested to Ask your employer to issue 2 letters or in one Letter with separate duties and period for the 2 NOC codes you were issued.

Unfortunately my company doesn't support Immigration and wouldn't provide the letter describing 2 different duties. So would it be fine if i recieve a letter from the company for the current duties and attach a cover letter that states the duties are combined for the entire duration. 2174 and 2171 has similar duties and 2171 being at a higher level (Analyst) compared to 2174 (Programmer) ? Do you know any one who had a similar case and what additional document did they provide ?

Hi Arun

Since your company reference letter doesn't state all the duties you performed, you can go for attaching an explanation letter about you what you prefer for. CIC will surely consider this one.

Also if you going to apply for bowp, you can work either in noc 2174 or 2171 , its an open work permit. All the best :)
