Hello,

I'm currently employed as software developer in Manitoba, I've applied for MPNP - got invitation to apply and submitted full application about 3-4 months ago.

But at the end I want to quit my job and start working as a business (I can start making much more money instantly and even employ local people, I was earning significantly more already before coming to Canada - reasons to move weren't economical).

Due to that I have 2 questions:

1) Can I quit my job as soon as(if) I get nominated by MPNP (and still be eligible for EE)?

2) If I get nominated but quit job - I probably cannot legally stay in Canada? If so - can I apply for EE from abroad and come back to Manitoba as soon as/if I'll get approved/provided PR ? (i.e. won't it be a problem that MPNP was inside Canada stream but I'll be applying from a different country)

1. If you wait to get your MPNP nomination before quitting your job with the clear intent of working as a business owner/entrepreneur afterwards, your PR application to IRCC as a skilled worker would not be true and in good faith. You would be applying to IRCC with a clear intent to omit/misrepresent facts, and this could (but may not necessarily) lead to dire consequences in the future. The basis for approving your MPNP nomination would be because the official in charge of your application believes you would settle in Manitoba as a skilled worker.

2. If you quit your job after getting nominated, you could still legally stay in Canada by applying for a visitor visa (change of status) but this could get complicated really quickly. If you apply for EE from abroad (I'm assuming you're certain your expected MPNP nomination would be for the EE stream), IRCC would notice that your nomination was as a SKILLED WORKER IN MANITOBA, and this could raise a red flag.

If I were in your position, I'd wait for the nomination and apply to IRCC through EE (since you seem to be sure you would be nominated as an EE applicant), and then wait for 6 months or less to get the PR. As an inland applicant, your application could be processed in as little as 3-4 months. Then after getting PR, I'd quit my job and start my business. That way, you won't have to worry about anything related to your PR or eventual citizenship, now or in the future.
