Hi everybody... we just heard a couple weeks ago from Immigration and were asked to do the RCMP and PGR so we are very happy we are in process and just have a few more steps to go :D I was looking on CIC about the ARC and we realized that my husband had an Exclusion Order not a Deportation Order...on the website it says that if it has been a year that we don't need to do the ARC (a year would be June 18)....does anybody have experience with this? We are wondering if they ask for the ARC if we should request to delay our case until June 18 so we don't need to do the ARC or if its better just to do the ARC? Thanks!

I dont know if u can request a delay
but i do know for mine and chuladaas rcmp it took them about 1.5 month to process it.

so if u dont send the rcmp and pgr untill closer to ur "due date"
than u should be clear, if ur exclusion order is up when they go to ask for ur arc, they wont ask for the arc :D

I forgot to ask this. So tomorrow my wife and kids land in Canada, do they have to wait long for paperwork when they get to customs? What's the usual procedure?

I would like the answer to this question as well so I can kind of prepare my hubby for it. Any insight would be great! And Dazz13 I am so happy for you!!! You must be having such a wonderful day today :)

depends how the lineups are, sometimes people get through in a few mins and sometimes in an hour or so.

I believe they just ask a couple questions, confirm ur address where they will be sending the pr card. and give u a little info on how to get ur sin card health care etc.

and sometimes they ask for the b4 form, but sometimes they don't.

I don't have any experience with this however I've read on multiple thread that this information is not true, they should ask for the ARC anyhow :( ...Sorry.. I hope this not true since I'm in the same scenario as yourself

I just had a friend go through mexico, and her husbands exclusion order was up before they were done processing, so he was never asked for the arc. Im not sure if he got lucky, or if that's the standard but it makes sense if the exclusion order is up there is no reason for arc.

hopefully neither of you need it! its a pain In the butt! lol

I definitely missed part of this conversation, my wife was asked to leave (removal order) in December 2010 and we only just started the process, does this mean we won't have to do the ARC?

Did she get a 1 year ban(exclusion order)
or was it a departure becomes deportation order?

I'm pretty sure it was an exclusion order, she applied for refugee claimant, was denied, did the ERRAR and then was refused for that as well, after that they sent us a letter that she had to leave on December 22nd, we went and begged them to move it a little further (because of the holidays) and they agreed to move it to January 22nd, she then left Canada on January 22nd.

sorry what is errar? do u mean prra?

if she applied for refugee, it would be a departure becomes deportation order.
usually exclusion orders are given to people who were caught entering Canada illegaly, staying in Canada illegally, or working illegally.

but denied refugees all get departure becomes deportation.

unfortunately yes, she will need to do the arc, they will ask for it at the very end of the process, and it takes about 2 months to process, but I have seen one go through in 2 weeks through mexico. the only time it takes longer is if she was in trouble in Canada, or was arrested before being sent home, which I can see from what u said that is not the case.
They ask for a $400 fee, plus a letter stating why u should be allowed to come back to Canada, and because she was a failed refugee there is a very large chance they will ask for documents pertaining to her refugee case like the the decisions for refusal and the decisions for refusal of the prra as well.

my spouse had the same case,
failed refugee, applied for prra, denied, was asked to leave in 30 days, left, checked out at the airport, paid for his own plane ticket etc.
