His wife had previously sponsored another spouse 2.5 years ago so she would have to wait 3 years since that before sponsoring him = half a year to go.. the rest of the details were in another post not quoted I guess ::)

Oh, I see. :) I got the impression that his wife came through an economic class, since her ex-husband was her dependant. Maybe the OP can clarify if the ex-husband was a dependant or sponsored?
 
The part about the ex-husband being expired was the bit that alarmed me the most!

This might be an aside, but if you sponsor someone, and they 'expire' are you still on the hook for 3 years ???

I don't think there's an exception to the rule. Maybe it can be appealed under H&C considerations?

If your wife's 1st husband came to Canada as her dependent, not as a sponsored spouse, then you are fine.
Otherwise, you might not be eligible, depending on the details of your case.

I just thought i'd let you guys know that the government recently changed the law. You have to wait 5 years before sponsoring a new (second) spouse

You are right, cgangon. But there is a difference between a sponsored spouse and a spouse who came to Canada as a dependent in a class other than family class. The 5 year bar only applies to sponsored spouses, i.e. in family class only.

No, it's 3 years if you were the sponsor and 5 years if you were sponsored. Unless they just changed it again in the last week!

I think that's what she means, but like I mentioned, the 3 and 5 year rule only applies to family class. I think from what JPBS has mentioned his wife came to Canada by a difference class? Not sure though.
