Hello Sweden,

Its really not nice, that their is no consistency as to how they send communication, sometimes
postal letters and sometimes emails etc. I hope they just send us request on a missing document
after 3 months and dont send us whole packet. Anyone on the forum who just got missing document
request after 3 months and not the whole packet back.

His wife had previously sponsored another spouse 2.5 years ago so she would have to wait 3 years since that before sponsoring him = half a year to go.. the rest of the details were in another post not quoted I guess :

Oh, I see. I got the impression that his wife came through an economic class, since her ex-husband was her dependant. Maybe the OP can clarify if the ex-husband was a dependant or sponsored?

This might be an aside, but if you sponsor someone, and they 'expire' are you still on the hook for 3 years ???

I don't think there's an exception to the rule. Maybe it can be appealed under H&C considerations?

If your wife's 1st husband came to Canada as her dependent, not as a sponsored spouse, then you are fine.
Otherwise, you might not be eligible, depending on the details of your case.

I just thought i'd let you guys know that the government recently changed the law. You have to wait 5 years before sponsoring a new (second) spouse

You are right, cgangon. But there is a difference between a sponsored spouse and a spouse who came to Canada as a dependent in a class other than family class. The 5 year bar only applies to sponsored spouses, i.e. in family class only.

No, it's 3 years if you were the sponsor and 5 years if you were sponsored. Unless they just changed it again in the last week!

I think that's what she means, but like I mentioned, the 3 and 5 year rule only applies to family class. I think from what JPBS has mentioned his wife came to Canada by a difference class? Not sure though.
