Hey Guys

So, last week Monday, a SC officer contacted us asking questions about our first LMO that was refused. She also asked about our recruitment done.
The thing is that, originally when we started the new LMO/LMIA (9 months ago) we were advised that no recruitment was necessary because it was only for a 6 month TWP and it fell into film and entertainment (NOC: 5131).

We submitted our answers on Friday last week, and this morning we found out the LMIA was refused because of no recruitment efforts.
How would I proceed now? The senior SC manager advised that he would waive the recruitment requirement when we originally resubmitted our forms for the new LMIA process. But now its rejected based on recruitment and recruitment alone. No other reasons.

My lawyer says there is no appeal procedure in place for TWP. Im literally screwed. I cant wait another 9 months.

Im about ready to give up!

Sorry to hear that. We can understand how it might be feeling. I am in the similar position. Mine comes under Digital Media occupation where recruitment is not required. It is clearly mentioned on the esdc website. To be safe , we have attached a copy of the published article so that the officer reads it before saying we haven't done recruitment ( i am not sure if you have done that). I know it is late now but may be it would have been better if u would have attached a copy too, knowing how lame these guys are up to. It is clearly mentioned here

Hey Greg, So what are you gonna do now? Cant u appeal since u have a valid reason to?
 
Can someone tell me when should i hear from them as LIMA application was sent on September 09, 2014 and file number was received on September 16, 2014 for Alberta NOC: 6211 $19.00/hr.. ?

We have no idea. We can speculate but there has been no approved LMIAs on this forum for awhile now.

My Employer got one LIMA approved for his other business which was applied in Mid August and they got reply in Mid October and that was for Supervisor position in Alberta. So, I am hopeful. :)
 
21 weeks since application, 8w since receiving a file number and no decision yet. I wonder how bureaucratized this process should be to take that long.

Mainly to do with why a certain person wasnt considered for the position.

The reason my employer gave satisifed the VO and granted my lmia.

So my timeline for those wondering.


August 12th - Original forms submitted.
September 12th - Original forms never recieved, resubmitted.
October 3 - Payment taken and file number given on same day.
November 11th - LMIA approved.

The wait is finally over.

Wow Congrats Jay. A lot of em were waiting for your news. Lol at least i was. Congrats man , time to celebrate indeed. Im sure u must be feeling like a re-birth

Hey! Congrats to you mate! So just have to get your work permit then? Did they say how long that takes? Flagpoling it?
 
Yeah except no time to celebrate!

I've got to go flagpole and get my work permit before the busy weekend at work.

I am sure ill find a time to squeeze in some drinks along the way! haha (just not when im driving to the border, that would be crazy)

Oh thats interesting, can we do that? I mean cross the border and get the work permit ? Than applying for a restoration n stuff?
