Hey

My first LMIA renewal was rejected as we did not meet the advertising requirements.

I applied again on July 20th
I am actually not 100% sure when we received the file number
Around the 20th August they requested we add schedule C transition plan
On August 26th we submitted the TP
They requested changes to the TP on August 28th
Requested further changes on September 22nd
Fax received 23rd September with approved LMIA.
Oh they fax it? Interesting!

@ BritEm: can you pls let us know how long you will get your work permit on that positive LMIA..bcs as above median wage they didn't specify the time duration of work permit..
Hey @dh5689 I have 2 years. I had an initial LMIA from July 2012-2014 and now I have another 2 years. I wont need that amount of time as I am actually quite close (6 months ish) to having my PR.

Aswell as timelines can people share their noc and province aswell please?
My NOC is 2171 and I am in Alberta. My application was submitted in the last 2 weeks (unsure of when exactly my employer sent it off).

I am in the top 10% of wage earners so I am hoping it comes through soon, but am not confident that it actually will (I guess not getting my hopes up!). I have a bit of time and also waiting for my CEC AOR so not too stressed just yet.

Did your employer have a phone interview by service Canada Before you get a positive lmia by fax?
hey
well we had been back and forth with a lady from Service Canada for 2 weeks trying to get the Transition plan sorted, but other than that no calls or anything just completely randomly faxed through- we thought we were in for a way longer wait

my employer had an interview with service Canada for an hour on Sep 16 and the officer could not make a decision therefore she will discuss it with her supervisor than nothing heard from them.
I was told by my immigration lawyer, that if they are going to reject it- they will typically just do it there and then. When they contact you and take some time to make a decision, its usually a positive. I wouldn't worry too much although I KNOW how frustrating it can be. My partner (also from England) was unable to work for6 weeks due immigration issues and I thought I was about to go crazy! Keep us updated!

CIC did, there's lots of info already on the forum on that subject and 2 of my friends have been sent home and had their applications for PR cancelled because they were working while they thought they were on implied status. Even the CIC call centre is unreliable on the info they give as it is a matter of who you will speak to but if a deportation order is made, then there is nothing you could do or say on the matter.

There has already been a written response by CIC to a member here as well, clearly stating IEC doesn't benefit from implied status, which pretty much closed the whole subject. I don't remember the name, other members might.
Thats pretty much weird. I can tell you from the first hand that I had implied status while working on IEC. Since my LMO got rejected, after a month I received a letter from Service Canada which stated the exact date when my status stopped to be valid. That date was approx 2 months after expiry date of my WP. I also have many friends who were under implied status after IEC.

I can't find the link now, but I've read the definition of implied status in some Operational Bulletin, which officers use when they assess applications. But here you can find more about it: http://www.cic.gc.ca/english/resources/tools/temp/visa/validity/implied.asp

It is clearly written: "If a temporary resident applies for renewal of their work or study permit and their permit expires before a decision is made, R186(u) and R189 (the right to continue working or studying under the same conditions pending a determination of their application for renewal) apply only as long as the person remains in Canada."

Glossary http://www.cic.gc.ca/english/helpcentre/glossary.asp#i says "If a visitor, student or foreign worker applies to extend their status, before that status expires, they can legally remain in Canada until a decision is made on the application. In this situation, the person has implied status."

Now, some people are confused with how to get this status, and they think if they only applied for LMO/LMIA, that's sufficient. Well, that's incorrect. You can benefit from implied status ONLY if you asked for extension/renewal of work permit. With that application you are asking to extend your status, what means you are asking to extend a status of a temporary resident, because that's what visitors, students and TFWs are. Also, with concurrent processing you are not asking (and please distinct this) to extend your work permit. Extending work permit is something else. In case of concurrent processing (which means getting applied for LMO/LMIA and work permit in the same time) the applicant fills the form which is called "Application to Change Conditions, Extend my Stay or Remain in Canada as a Worker", what means that the applicant is asking to change the conditions. You are not actually extending your current IEC WP.

It is also questionable how long your friends worked under "implied status" and if they really had it or not.

I just know that it IS possible to have implied status if you are working under IEC, because I personally had it.
