The simple answer is that no, you don't need a certain income to sponsor your spouse. In CIC terms, you do not need to meet a specific Low Income Cut Off (LICO) point in order to qualify as a spousal sponsor. However, you cannot be in receipt of social assistance for reasons other than disability, nor can you be an undischarged bankrupt. Furthermore, if your income is on the low end, and your spouse cannot show that they have income-earning skills (such as a job history, or a good command of the English language) you may run into a Section A39 situation.

Section A39 gives CIC the power to deny a spousal sponsorship if they feel that the spouse is unwilling or unable to support themselves and the Canadian sponsor has not provided adequate proof that arrangements not involving reliance on social assistance have been made to care for their needs. There was one such case on CanLII where the wife had no English language skills, had never worked outside the home, and her spouse himself had never held more than low-income jobs, did not have a home of his own or any significant savings. The sponsorship was denied and the denial was upheld on appeal, because in between the denial and the appeal hearing, nothing had changed in their situation.

Anyways, sorry if that was overly detailed, just wanted you to have a full picture of how the income thing works for spousal sponsorships.

Currently I am working with a low-income job, and have for a long time... I'm young.. going to go to college on OSAP... maybe later after I start the process of sponsoring my husband.. he has work history... didn't pass University and lives in Egypt... he has not bad work history and took university for accounting as well as he has xperience being an oddett... I odnt have any saving at the moment either
will I be rejected? as well as I live in subsidised housing with my mother... with this make me be denied?
I dont have monney to reapply again.... 475$ plus 75$ on my own is so much
:'(

Hi Spritz.

It is not for certain you are going to be denied, so take heart, OK? Persons who are students have been approved to sponsor their spouses. What you need to do is present a strong application that covers any areas that CIC may have doubts about.

1) You live with your mother, so that gives you a roof over your head. It is important that she writes a strong letter on your behalf, talking about your relationship with your husband, and any contact she has had with him too, that she is aware that you are sponsoring him, and that she is prepared to provide support for the two of you where needed.

2) Emphasise the fact that your husband has transferable work skills. In the meantime, see if he can take courses to improve his English, if he is not very strong at the language already.

3) Save as much as you can right now. The fees can be paid in two parts: $550 first for the application, $490 for the landing fee when he is approved. Paying the landing fee when asked can add a little more time to the processing, it's true, but if that is the only way you can pay it, then you have to work with it that way.

Hello CharlieD10,

Thanks.. I just don't want to loose this chance to sponsor him at all. I will definately do all this.
Subsidized isn't a problem to mention though? do I need to mention it?
My mother is also on bankruptcy is that going to affect a letter saying she will help at all?

There are places on the sponsor's forms for noting whom you live with, but nothing else is required in terms of information regarding your living arrangements.

By "support", I do not necessarily mean financial support, it includes emotional and other kinds of non-monetary support, so you don't need to worry about your mother's financial situation making you ineligible.

Thanks.... I've calmed my nerves a little bit, I hope this works! :)

I dont like that canada makes it so hard for me to see my husband again :'(
