TY Chickie, do you know if your hubby's friends that ran off the farm were in legal status when they got married... he also has some friends that left the farm and married Canadians and they sent in inland applications too, but their work visas were still valid when they married and applied. His visa will be almost 2 years expired by the time our application for sponsorship is sent in. Our biggest concern with applying inland is that once we send in the forms and pay the fee etc, we are basically telling immigration here he is, illegal, and btw here's our address,.. come get me. We just assumed that

Hey there, I can only speak from experience of his friends, but yes they were "illegal" when they married, no work visas not valid and they are still waiting on their paperwork. I know of one that actually just this year got a work permit while he is here waiting for his paperwork to be finished.

i just did some more reading about the outland application and found that part 1 in missisauga would take approx 2 months... but then part 2 done at the kingston office is approx 16 months wait (omg!!) .. so, for us.. (he is here in canada now) would this mean after the 2 months if approved for sponsorship he would need to go home for the interview and stay in jamaica that long before a visa would be approved? that seriously scares me....

and another thing... how come i don't get to have a cool icon/signature like everyone else... is it becuz im too new to the board?

If there's an interview, it wouldn't be immediately after sponsorship approval, but some time later in the process.

Unrelated, but I love reading this thread just so I can see the patois you all type in. I read the POS thread for the same reason! Hope you don't mind me lurking :)

Lol most people don't understand our language... Feel free to enjoy! :P

So in browsing another thread, one person's comment was "I will have my visa next month in Jesus name".. Then I remembered reading a book called The Secret and it basically says that you can speak something into existence if you really believe and keep good thoughts.

So, "MY HUBBY AND I WILL BE IN CANADA BY DECEMBER 31st, 2012" COPR in hand! I declare this!!!! And am thankful for it!!!

;D

Call me crazy but I believe it can happen!! by the way anyone read that book or are you girlies into sex, love and horror stories?

Half my family's Trini, so that helps :P :P Gotta take the hubby down to visit at some point, and he won't understand a word! (I had to translate when he met my grandparents)

Isometry - nice of you to stop in and lurk! Since you've already landed, can you please share your story with us? What were your experiences with immigration and the process?

On one hand i think, nah... they won't bother to deport him.. we've been honest and now want to make things right, plus there's costs involved to them to deport him, as well we'd be married and eventually he'd be back in Canada anyway after re-filing outland.. it would just be a waste of everyone's time/money... but on the other hand.. i am worried cuz i can never be that lucky.

I knew someone who was out of status in Canada (came up many yrs ago on a visitor's visa and never left). They applied through inland, process took about 18 months, right in line with the CIC timelines. The application went through successfully, no deportation threats or anything.

Have you looked into the rules around the public spousal policy? If I remember correctly, it states in there that immigration status is not to be a hindrance in spousal PR applications. It also says that the undocumented spouse will not be documented during the application. Note however this is provided that at the time of submitting the application, there are no outstanding deportation orders or anything. If there is currently one in effect, they can and will enforce it once you apply.

Here is the new addition!
