From what my sister was explaining hubby had to remain in Canada and couldn't return home (Jamaica) even for an emergency while the PR app was in process. According to her he had to apply for an open work permit (OWP) so he could work while they waited. He was already here in Canada on a work permit so he was able to get that extended while he applied for OWP. In all, things only took 8 months opposed to over a year so he didn't even end up needing the OWP.

I do know they went to Jamaica right after the package was mailed and returned before she received sponsor approval, this didn't affect their application. She did mention however that they had to provide proof they were living together after marriage because they had not been before then.

According to CIC

"Leaving Canada can automatically cancel temporary resident status as a visitor, student or worker.

The person being sponsored has no guarantee that he or she will be permitted to return or re‑enter Canada if he or she leaves before permanent residence is approved. This is especially true if a Temporary Resident Visa is required to enter Canada."

Though some inland people get lucky and get through in 8 months but the majority are waiting closer to 2 years before their applications are processed. I've seen a couple people travel on OWP but technically CBSA does not have to let you in the country so you do so at your own risk.

I am new to this, and hope that I'm posting this in the correct place.
I'm a Canadian sponsoring my Jamaican husband. I sent my application in early March and was approved as a sponsor shortly after that. His application was forwarded to Kingston April 1st and they started working on in April 21st. I haven't heard anything back from them as of yet. I recently wrote them to add our daughter to the file (she was born in March)

I submitted everything with his application upfront- fees medical, police report etc. Now my husband has children from his previous relationship and we added them to the application as non accompanying dependents. We never includedid their birth certificate or a medical for them.

So my question is even though they will not be coming when my husband does will they require these documents and if so should we get them done now and write the KVO and request that they add to the file? Just to speed things up and avoid delays.

Also any tips or advice is welcomed. I'm excited I found this forum and have people that I can relate to.

Hello and welcome yes his children will need to have Medicals even though they won't be coming up as the same thing as him.

Welcome! I do believe any children (accompanying or not) need to be added to the application.... My husband doesn't have any children from previous but, maybe others who do can speak on this more. Just best to add them before hand as I believe they have to be, to ever be able to come later on as well as Medicals need to be done for them also?

You are correct. You will need to get the medicals done ASAP along with sending in a copy of their birth certificate. If you choose not to do this your husband will have get a notarized affidavit stating that he knows that he will never be able to send for his kids. If you want to avoid this it is best to add them to the application now.
 
Thanks for the quick reply. The kids are already on the application however no birth certificate or medicalsomething were submitted for them.

I will have my husband start this ASAP. Once completed is it best to submit it via email through the case-specific enquiry form or via mail to the address in Kingston 3 West King House Rd?

The doctor would forward The medicals directly you can send through cse the receipts for them and the birth certificate

My husband's ex is refusing to giving him a copy of the birth certificate and also refusing to allow him to complete the medical. She says it's her one son and she will never be sending him anywhere.

Question now is how do we proceed. Can I remove his name from the application?... how would I go about doing that?

So frustrated *sigh

Unfortunately you can't remove his name from the application as the would be misrepresentation and lead to an immigration ban. You husband will need to have a notarized affidavit saying that the mother of the child will not go through with the medical and that he understands that he will NEVER be able to sponsor the child. The only way Kingston will complete the application is either with the notarized affidavit or the medical and birth certificate. We had to this for my one of my husbands kids. It was really hard decision to make but sometimes you have to do what you gotta do.

unfortunately this seems to be the norm he needs to explain to her that even though he's not coming to live here right the medical needs to be on file if she's still refusing she needs to know he will never ever be able to sponsor him again in the future if she still refuses he can go through the courts which will take time or sign an affidavit acknowledging that he won't be able to ever sponsor him. Good luck.

We just typed up a letter stating the info(including UCI and application number) then got it notarized at a notary public in Ocho Rios. The notary public will ask your husband if he is sure this is what he wants to do then he will stamp it. I would suggest making a copy for yourself to keep. Then mail in the original to VO via carrier so you can see if they sign for it or not.
