We can file for her visitor visa after I complete my landing. For visitor visa, we do not need to show marriage date or anything.

Will this be ok?

Is she coming from India? I'm not sure whether her putting your details on her application will affect your PR, but it will affect her ability to get a visa...most visa offices are reluctant to give trv to spouses. You are going to have to show some significant ties to India to prove she will return once her visa has expired.

Good luck,

Lynn

I personally think You would get found out...she would have to supply marriage certificate etc in order to obtain a TVP for your spouse! It will look like you lied! When your passport was requested did you not get a form to update your details? I know it says its an offence not to tell CIC of any developments of your relationship (marriage, common-law, deaths and births) before your PR is issued!

What I understand from the PR process is once my PR visa is issued, my file is closed. If I tell the CIC about my marriage, they will cancel my PR visa (others can correct me). And, if I reapply, I do not qualify for FSW anymore.

I do not know what to do. I do not have a marriage certificate yet.

I know its total bad, but I can complete my landing now as a single and then may be try to get a marraige certificate with a later date.

Please help!

Were you married in India?? Do you not have to register it in Canada or US for it to be legal in Canada? I thought I saw that somewhere?

I was married in India. Registering marriage is optional, and you don't have to register it right away.

After registration only, you are issued a marriage certificate.

When you register what date do you put on? Can you just make it up? Or do you have to provide some kind of proof that you married on that day? Honestly, who's to say you are actually married?? You know what I mean?

Lynn

When u register your marriage, you need to have 2 witnesses to sign , and basically u provide all the information on all the forms. There in no way to find out if u were actually married on that particular day.

So in theory you could land and then register your marriage and pass it off as happening after you landed? Only problem with that is..wont you marriage date appear on the Certificate?

If you did this and Sponsored your wife they would need proof of you going to India and your marriage i.e ceremony/ reception and proof or of arranged marriage or if you chose to marry..you could get away with it but you would taking a huge risk..I can guarantee you will have an interview and may find it impossible to convince the IO you married later than you did!

Wow really thats odd! :o

You don't NEED to re-qualify under the new list of occupations!!!

DO NOT LAND. Advise the visa office of the change in your marital status. Supply updated documents regarding your wife and your marriage. Yes, they will cancel the visa you have now but only so they can evaluate your wife for admissibility. If everything is fine, you pay the required fees, medical is ok, you have adequate settlement funds (if required), then you will BOTH be issued visas. You are NOT starting all over again nor do you have to meet the new criteria.

Hi britincanada,

Thanks for putting your time and thought. In theory I CAN do that. I can land in Canada now from the US, and come back. I plan to go to India for 1 year before I finally move to Canada. During that time, I can get my marriage certificate done, and apply for my wife's PR from India itself.

To rjessome, are you 1000% sure that I will not have to restart? What I have read from forums is that your file is closed on PR visa is issued. Anything after that is new.

Please confirm

100000000% sure!!!!!!!!!!!!!!!!!!!

Direct quote from OP Manual for Federal Skilled Workers:

Family members can be added to the application at any time during the process, including after
the visa is issued but prior to obtaining permanent resident status
. Applicants should be
counselled to inform the visa office immediately if their family composition has changed.

rjessome, I understand what you mean. However, this might be the case only for people who ACTUALLY got married after the PR visa was issued.

In my case, I was married 3 months ago, and I got my passport with PR visa today. If I inform the CIC now, they migh reject my case all together.

I know its my fault, but please suggest.

I am 100% with rejessome...Although you may be able to fudge your marriage certificate you will be caught in a lie..from my experience its always better to tell the truth...I too had to face the music! So I know how you feel

You can not apply for your wife's PR from India because as a PR, you must be residing in Canada to sponsor as well as if they find out that you were actually married to her when you landed, they will refuse her PR and may even revoke yours.

Really, you should inform CIC that you got married and add your wife to your application.
