I was searching in CIC website about the job offer and LMIA factor and found this:
Your employer doesn’t need an LMIA to support your job offer if:
- you have been working full-time for the employer on your work permit for at least 1 year (or an equal amount of part-time work)
- you have a valid job offer, and
- you have a valid work permit that is exempt from an LMIA under:
- an international agreement
- a federal-provincial agreement
- the “Canadian interests” category
does anyone know if between notes 1 and 2 is a “and” , “or” ? I have worked for an employer for more than 1 year and now I have a permanent job offer, I want to know can I proceed without LMIA according to this note? Or I should have all 3 factors above?
