I was searching in CIC website about the job offer and LMIA factor and found this:

Your employer doesn’t need an LMIA to support your job offer if:


  1. you have been working full-time for the employer on your work permit for at least 1 year (or an equal amount of part-time work)
  2. you have a valid job offer, and
  3. you have a valid work permit that is exempt from an LMIA under:
    • an international agreement
    • a federal-provincial agreement
    • the “Canadian interests” category

    • does anyone know if between notes 1 and 2 is a “and” , “or” ? I have worked for an employer for more than 1 year and now I have a permanent job offer, I want to know can I proceed without LMIA according to this note? Or I should have all 3 factors above?

Are you on a PGWP? If so you need a LMIA. You need to meet all 3 conditions. LMIA exempt permits are only given for inter-company transfers, trade agreements etc. Plus to count the 50 points, you need an approved LMIA exempt permit and then work in Canada for at least a year on that permit.
 
Just another question, can I use this job offer for applying through Ontario, International Student with Job offer stream? Or get an provincial nomination from Ontario? (I live and work in Ontario). As far as I know, the LMIA is not mandatory for the provincial streams

LMIA is not required but your employer must be eligible and fill out all documentation to support your nomination. They have to agree.
