i relocate to Canada in 2011 with a programm called provincial nominee, when we get our visa me and my wife had an issue and we are unable to resolve it before I travelled down to Canada with the hope that when she come join me we will be able to resolve it,but when she landed in Canada she decide to be living separately, and insist that she doesn't want to be in the marriage anymore,in January 2014 we both agree on divorce since we have been living apart for the past three years, she lives in Alberta while I live in winnipeg,we both contact our lawyers back in nigeria to file a divorce,my lawyer and her lawyer both agreed with the terms of the divorce,so we got the divorce certificate 5th of May 2014,but recently I travelled home to get marry to my new spouse and am trying to sponsor her,my question is:is the divorce certificate from nigeria will be acceptable by cic?

Probably not, since it appears that neither of you were residing in Nigeria at the time of the divorce.

Was it recognized?

The recognition of foreign divorces in Canada hinges on various factors, including the specific government agency involved and the objective for which recognition is sought. When the aim is to sponsor a spouse for immigration to Canada, IRCC is generally inclined to recognize foreign divorces, particularly because it routinely handles international cases.

However, the process can become complex if the goal is to remarry in Canada, as this involves different criteria and potentially additional documentation. Key factors that agencies consider when recognizing a foreign divorce include:
  1. The legality of the Divorce: Was the divorce lawful in the country where it occurred?
  2. Connection to the Divorcing Country: Did at least one spouse have significant ties, such as citizenship, to the country where the divorce was finalized?
  3. Consistency of Marital Records: The relationship trajectory is also scrutinized. For example, if the marriage and subsequent divorce both occurred in Nigeria, followed by another marriage there, this forms a clear pattern that supports the recognition process.
To determine eligibility, applicants typically submit their case to IRCC and may be asked for further evidence. For added security, obtaining a legal opinion from a family lawyer regarding the foreign divorce can be advantageous. This advice is often necessary for provincial authorities to accept the divorce, allowing one to obtain a marriage license in Canada.
