Dear Mr. Badil,

This refers to your application for permanent residence in Canada as a member of the provincial nominee class.

I have reviewed your application and all of the information you have provided in support of it and it appears that you do not meet the requirements for immigration to Canada.

Subsection 11(1) of the Immigration and Refugee Protection Act (IRPA) provides that a foreign national must, before entering Canada, apply to an officer for a visa or any other document required by the Immigration and Refugee Protection Regulations. The visa or document shall be issued if, following an examination, the officer is satisfied that the foreign national is not inadmissible and meets the requirements of the Act.

Subsection 87 of Canada's Immigration and Refugee Protection Regulations (IRPR) describes the provincial nominee class as "a class of persons who may become permanent residents on the basis of their ability to become economically established in Canada" and are “named in a nomination certificate issued by the government of a province under a provincial nomination agreement between that province and the Minister; and ... intend to reside in the province that has nominated them." In order for applicants to become economically established it is expected that they will be able to obtain gainful employment in Canada by which they can support themselves and their dependants and that they already have the abilities, education, and work experience which will enable them to procure and maintain such employment in Canada.

Nominations issued by provinces or territories are considered as initial evidence that nominees have the ability to become economically established in Canada and will be of economic benefit to the province or territory and have met the requirements of the province’s or territory’s Provincial Nominee Program. Canada is responsible for exercising the final selection authority and ensuring that applicants admitted under the program have met the requirements for membership in the economic class.

Notwithstanding your nomination by a province or territory, I am not satisfied that the information provided with your permanent residence application indicates you have the ability to become economically established in Canada or that you otherwise meet the definition of a provincial nominee as per Subsection 87 of the IRPR.

Included with your application for permanent residence was definitive evidence of your English language proficiency in the form of an International English Language Testing System (IELTS) test result. The IELTS results you submitted showed that you had received an overall band score of 5.0, which is described by IELTS as "Modest user: has partial command of the language, coping with overall meaning in most situations, though is likely to make many mistakes. Should be able to handle basic communication in own field." Your individual band scores for speaking, listening, and writing were 5.5 and therefore also those of an IELTS modest user. Your score for reading was 4.0, which is described by IELTS as “Limited user: basic competence is limited to familiar situations. Has frequent problems in understanding and expression. Is not able to use complex language.”

The ability to communicate effectively in one of Canada's official languages is recognized as a vitally important factor in becoming economically established. Information on the Immigrate Manitoba website also confirms that nominees are expected to have the "demonstrated ability to get a job in their occupation and establish in the local labour market, thereby making an immediate economic contribution to the province" and that "job-ready English" is now required to apply to immigrate through the Manitoba Provincial Nominee Program. Your language test scores indicate that your level of English language proficiency may be described as moderate in speaking, listening, and writing, and basic in reading.

Critical in determining your ability to economically establish is a comparison of your information with the requirements of the occupation indicated in your nomination. The occupation in which you have been nominated by Manitoba is technical sales specialist - wholesale trade. The occupation which you indicate you would intend to pursue in Canada is technical sales officer or related jobs. The occupations in which you indicate having experience are technical sales officer, and research officer.

I am not satisfied you have the language skills to be able to perform the duties required of a technical sales specialist in Canada. Technical sales specialists need to be able to identify and solicit potential clients and assess their needs, as well as to prepare and administer sales contracts, resolve clients' problems and provide ongoing support. It appears reasonable to expect that to carry out duties which require close contact with clients and a thorough understanding of their needs would require a greater than basic or moderate level of English language proficiency. As already indicated, your language test results demonstrate your English language proficiency to be at only a moderate level in speaking, listening, and writing and only a basic level in reading. With the level of English language ability you have demonstrated, I am not satisfied that you would be able to perform the tasks of the occupation for which you have been nominated, and in which you also indicate having experience. Notwithstanding the province of Manitoba's nomination as an indicator of your employability, I am therefore not satisfied you would be able to become employed in Canada or, if you did find employment, that it would be of a sufficient level for you to become economically established.

A copy of this letter is also being sent to the nominating province to advise of the possible refusal of your application and the reasons for it. The province has 90 days to raise concerns or seek clarification from the visa office regarding the assessment of your application, after which the final decision will be made. If you have further information you wish to have considered, you must submit it within the same 90-day time period. Extensions to this 90-day time period will not be granted, but all information received before the final review of your application will be considered.

London Visa Office is notorious for rejecting applications on the basis of IELTS. They did it on numerous occasions before. Surprisingly other visa offices have no issue with the same IELTS levels. This contradicts CIC policy as other visa offices accept the same IELTS results but LVO rejects it.

LVO do IELTS assessment on this website as per individual NOC and skills requirements

Please beware this is just a fairness procedural letter and not a rejection. They gave you 90 days to justify that, but you have already submitted your improved IELTS results so you should be fine. But please share your revised IELTS results here.

I think the NOC 6221 is more specific, related to import export. This is mentioned in NOC requirement list the language profeciency essential. So, this is also a reason.

Hi,
According to you IELTS score and your NOC, it does not meet their demand about English Proficiency. But in their letter : "A copy of this letter is also being sent to the nominating province to advise of the possible refusal of your application and the reasons for it. ......, but all information received before the final review of your application will be considered." I think you still have a chance to submit a higher IESTS band score in 90 days.

What others have said. Submit new IELTS results within 90 days. I would make sure you score at least 6 in each of the four categories. Your current scores are really quite low and it's not surprising you've received this letter.

Thanks for your expedite reply,
if the LVO did not rejected my case till now then why LVO sent me an e-mail (dated 19 May 2016) like the above one with full explanation and and with references. If LVO was just concerned about my improved IELTS then LVO should just say that you have low IELTS band score over all or any specific module module. so just improved it and send us in 90 days . Any body can reply Please ?
for information:
I have submitted my improved IELTS dated 21st june 2016 as overall 6 band (R:5 L:5.5 W:6 S:6.5). is it OK now for my NOC 6221. if yes then plz here i have few questions:

1- can i expect that my other documents are ok, as they are just requiring my improved ielts.
2- where should i had to send my improved IELTS result ( either to the same e-mail address of LVO from where i received this mail or any other).
3- 3rd how much time LOV can take to sent me Medical request.

I am fully disagreed with you. If LVO not considering low IELTS scores then this IELTS requirements must be the global not specific to Province to Province. Anyone can easily understand the difference between LVO and other Visa offices.

Hope u understand but i am not considering your response as vital. Sorry.

NDVO may not that strict as LVO is but its a heads up for everyone and specially for those whose applications will be processed in LVO including myself. If you search rejections on the basis of IELTS score you will find plenty of applications were rejected by LVO alone.
The problem is that province is keen to get more immigrants even on their low IELTS score (like SINP) but CIC has ultimate authority to issue visas and when it comes to LVO they simply disregard nominations if your IELTS score is not up to the mark.

CIC state on their website that PR applicants require CLB level 7, that means IELTS level 6. If your overall is an IELTS 6, they may accept it, but they do not have to, technically you should have level 6 in all four language abilities. If other visa offices are accepting lower then they are breaking CICs rules.

I think you would be best to contact Manitoba immigration as soon as possible and explain to them what has happened, and ask them for their support in dealing with this issue. If they contact the LVO it may make a lot of difference and may persuade LVO to let it go through. Do contact the LVO and confirm that they have received your updated scores too. Can you also explain to the LVO what you are doing to improve your English? If they know that you are making an effort to improve your skills that may also make a big difference.

I don't mean to be rude, I myself have lived in a country where my language ability of the countries language was similar to your ability in English, it was a struggle to communicate professionally and I am multi-lingual and learn additional languages quickly, but it does make things more stressful.

Hope you get it sorted.

Thank you arsal for your reply to this, yes i agreed with you because LVO is the only who rejecting the application. And i never saw that NDVO is doing same. I am worried because i fall under overall band score of ielts is 5.5 and got my SINP nomination under NOC 2281 also my Visa office is NDVO. Just 4 days back i applied to CIO after my nomination.

The case I posted is Naeem Badil's case who got this email from LVO.

I have got overall score of 5.5 as well with S & L in 5.5 each, W 6 band and R at 4. Would you mind sharing your individual module score?

The IELTS requirements you mentioned above are to do with Express Entry and FSW. The requirements for PNP nominations and paper based PR application to CIC are different and relatively relaxed. Officers in LVO are very rigid and they don't normally satisfy with English requirements until you provide them good IELTS score. Even if you provide alternative arrangements they simply disregard your application. If you see judgements on Federal Court website, you will find plenty of recent rejections and the appeals against LVO attitude towards strict IELTS requirements.

After a detailed study I found that LVO check your IELTS score against the NOC skills and knowledge requirements on this website

One should check their reading, writing, oral skills requirements against their NOC level and assess their current IELTS score based on this. LVO normally refers this whenever they send procedural fairness letter to applicants.

That isn't the case, our PNP officer from our nominating province told us categorically that PNP applicants still have to meet the EE and FSW IELTS scores as they are the over arching CIC national PR requirements.

Sorry @the super king, I should have said to contact Saskatchewan as soon as possible, not Manitoba, I assumed that as LVO quoted Manitoba in their email that you must be a Manitoba nominee. We were told that any issues at all we should contact our province as they would help us as best they could.

Also, if your reply has come from LVO, then your visa office is London, not NDVO. Are you currently residing in the UK?
