Impaired driving arrest while on work permit

Hello everyone,

I recently got arrested for having BAC (blood alcohol level) .16, which is over the limit of .8. The police impounded my vehicle and licence is suspended for 90 days. They've given me notice to appear on 5th Dec, it says that this is not a trial but they will discuss the maximum penalty associated in my case if I plead guilty.
I'm currently in 2nd year of my work permit (PGWP). Can I still apply for PR or there is no chance. I was caught in parking lot with ignition on. I dint got involved in any form of collision or accident. What should I do please guide. This is my first offence.

PS: my fiance is in process of PR as all the requirements are fulfilled and we are planning for registered marriage after she receives her ITA. In case it helps me to retain my status.

Find a lawyer immediately. If you are convicted, you will likely be deemed inadmissible. And if you are deemed inadmissible, your wife (if you get married) will also become inadmissible.

"If you have been convicted of driving while impaired by alcohol or drugs, you will probably be found criminally inadmissible to Canada."

In the ideal world, we should encourage you to take responsibility etc. But in this case the consequences are extreme and will affect both you and your fiancee. So, find the best lawyer you can afford and do what you can to avoid conviction.

You need to be working with a very good criminal lawyer in your area (not an immigration lawyer) who can help to reduce your sentence to a non-DUI offence or get the charges dropped completely (although that may be quite challenging given how high your BAC was). You will likely have to go outside of this forum to find a recommendation for a strong criminal lawyer.

Note that if there are issues with your status as a result of this, marrying your fiance after she receives ITA will not help.

I am a PR and was in a Dui situation last year. My trial finished a few weeks ago and I was acquitted. You will not be able to apply for PR until your case is closed and if convicted, it will almost be impossible to get PR at least for 5 years. Getting convicted can have a major impact on jobs and travel as well. All I have learnt from this is to never ever drink or drive. It can destroy your and other's lives.

My limits were low right around 0.09 and that helped. Secondly what helped was getting a good lawyer. Do your research, not what just google recommends or the so called DUI specialists. Get an experienced and reputable Criminal lawyer. I know that it can be very expensive to get a good lawyer, but a conviction can have a huge impact on your life.

Read the above similar issue, it might help. Depends on your license, quantum of alcohol consumed, and if you're authorized driver. Above all get a specialized criminal lawyer. What did cop says? Has the cop charge you to court?

Get a lawyer. If you are convicted, you will be inadmissible to Canada and you won't get a work permit approved after your studies.

1. And s/he probably will be unable to complete their studies, serious criminality and CBSA will report if s/he is convicted.

Did you get your workpermit after the studies
Same thing happen with me am a student here

It happed in Brampton,ontario on 28th oct
Am driving my car , a police office pulled over witkout any mistake just for random check and the results are positive
After that in machine ratings are 90,90 and the first court date is on 23 dec
