Hello,

I am applying to sponsor my spouse, we meet and married during my vacation to Bosnia this year (2014) and we married in Bosnia. I have now returned to Canada and wish to apply to sponsor her.

Going through the application process for form IMM1344E I have a few questions that are very unclear to me...

Question 6: Status in Canada? We immigrated to Canada during the Bosnian War and I am a Canadian Citizen since 1999.. does this mean I am a "Naturalized Canadian Citizen"? If so, where would I find the information for UCI/Client ID. The only document I have is the Canadian Citizenship Certificate which has a 7 digit number at the bottom and year?

At the bottom of the application it asks for signature of both the sponsor and the sponsored person, the sponsored person is in another country currently, do they have to sign this? Must it be mailed to them and mailed back to me or can I scan the application via PDF and have them print it on their end, sign it and scan it back into PDF to me?

This is a BIG red flag. How long did you know her before you got married?

Hi canuck_in_uk,

Can you please elaborate why this is a red flag? I've chatted with her over Skype/Facebook for over a year, we never had the chance to meet due to the distance until I arrived there this year and spent the 3 weeks I was there with her..

Marrying someone the first time you meet them, especially when they are from a less developed non visa-exempt country, is a very big red flag for CIC, as it's an indicator of a Marriage of Convenience.

Having a previous online relationship is a big help but given the short amount of time you actually spent together in person, it's likely that your app will face extra scrutiny.

Thanks for the heads up canuck_in_uk, according to cci.gc.ca's site the Marriage of Convenience carries a description of "In many cases, sponsors and foreign applicants set up a “marriage of convenience.” This is a marriage or common-law relationship whose sole purpose is to let the sponsored spouse or partner immigrate to Canada.".

The case here is not just a ticket to Canada, thus if I stand my ground I don't see any issues with what I am doing. Hopefully the CIC will not give me a hard time, what happened to love at first sight? It will be very unfortunate if they scrutinize my application for this reason but i'll push as hard as I can.

Principal applicant (person being sponsored) also needs to sign. Actually the need to sign a lot of forms in this whole process. So, coordinate with your partner about which forms she needs to print there, sign and courier over to you here.

Hi ydj_dil, thanks for the reply... I do have a question, must we courier the forms or can we sign/scan/email/print?

Unfortunately, "standing your ground" doesn't have any effect when it comes to CIC. Head over to the appeals thread to see how many people stood their ground about their genuine relationship and were still refused. Or go to CanLII, http://www.canlii.org/en/ca/irb/, search for "Marriage of Convenience" and read through some of the cases.

I'm not making any statement on your relationship but for CIC, marrying a non visa-exempt person from a less developed country the first time you meet in person is a strong MoC indicator. The online relationship is a big help but you should be prepared for extra scrutiny and submit a super-strong app addressing the red flags.
 
Unfortunately, you can't have her sign, scan and email to you from there, and then print here. The signature must be done in pen ink physically.

Simply because this is a legally binding document after you sign it. Say you lie on your form, come here, and CIC realizes later that this was a fraud. They will come after you, but they cannot charge you if the sign is digital, because you can say its "photoshopped". Therefore, they do not accept digital signatures.

BTW, tip: if she is in Asia or Europe, the paper size is different. They use A4 size, while we use "Letter" in North America. If you end up needing to correct a non-signature page later, you won't be able to do that cleanly without the right size paper. So, ask her to send you about 10-15 blank papers of the same quality and size. Its really difficult to find A4 paper in Canada - I tried. Had this happen to me - had to make a correction after I received the courier, and was really difficult to match the paper quality that she sent over.
 
Your wife will have to send you many documents, originals, copies, translations and so on. All the forms she needs to sign can be included in the same package she would send you. When everything is ready, both sponsor and sponsorship documents and forms , then you will have to send everything together to CIC Mississauga.

As for the paper size, I know it's different but I never heard of anyone having trouble printing the forms overseas.

And yes, marrying first time you met in person will be a red flag. Make sure you include a lot of proof, pictures, skype calls, phone bills , anything you can come up with. It would also help if family and friends could write a letter confirming they have known about your relationship for a long time.

Finding A4 in Toronto has been real difficult, especially to match the bluish colour tinge on the "white" papers in India. It just looks unclean to have a bluish white A4 paper set interleaved with a bright white "Letter" size paper. It might even raise questions about the authenticity of the form signature, right? Clearly the signature is on a different kind of paper than one of the pages of the form.
