If my spouse is already a PR, should i fill as non-accompanying?

If anyone could please help with this...

So my spouse has a PR but which he had applied for with his ex-wife three years ago. So he can't apply for me now, which is why i went through the express entry.

I just got my invitation to apply today and trying to fill the form should I put him as non accompanying?

When you answer your status as married, there's another follow up question which asks if this person has citizenship or PR. answer that as YES. Then I don't think the 'accompanying' question will come up.
