Hi all,

My IEC work permit expires in 31 days. I have a trip to the states booked just before it expires and I intend to flagpole at the border, with an intention of remaining as a visitor for a couple of months. I will have proof of funds, proof of travel insurance, a letter from my employer to say I am no longer working, and a flight out of the country to prove my departure date.

I understand that there are no guarantees that they will let me back in at the border, but I'm confident I'll have enough evidence to prove I'll be staying as a legit visitor.

I was also going to apply with CIC to extend my stay as a visitor, but wondering if this is pointless as by doing the trip to the states I will lose the implied status. Is this correct? I would need to do this tomorrow as it would be 30 days before the expiry of the visa, and according to the instructions I can't apply any later than that.

Thoughts on that anyone? Am I wasting my time applying for an extension as a visitor, given that I will already be flagpoling? Anybody see any issues with this?

Thanks!

Nowhere in the instructions does it explicitly say that you must apply for an extension at least 30 days before your status expires. The 30 days is just a guideline. As long as your extension application is received by CIC before your current status expires - you have implied status. Yes - if you leave for the country, you lose implied status.
