H4/H4 EAD extension along with H1 premium

Hello

This is my situation. My wife's H1 is up for extension. We want to file my H4 and EAD along with that. My Canadian citizenship is in process. Currently I am in the US. My attorney said i need to be in the US to file for H4 and I need to stay in the US until it is approved. Is that the case? My oath can be scheduled in few months potentially. What if my H4 is not approved by then?

If anyone has gone through this recently please update, it will be really helpful for me.

I believe that is because, USCIS may extend the H4 status along with H4 visa. If you travel, USCIS may approve the case without I94.
