Asylum claims are down 34% this year. Furthermore, the approval rate for asylum claims is 86%, while for H and C it is around 35%. It is much easier to be accepted as refugees for nationals of war torn countries in Canada than it is for H and C. Given the limited quota and huge backlog of H and C, it would currently take 5 to 7 years at least to become PR through H and C. Applying through refugee in 7 years they will become citizens. I am not sure what do you mean by economic immigrants. How many MDs, nurses, and PhD holders are among the pool of H and C and refugees inside Canada. Why IRCC do not prioritize those highly skilled immigrants who are working in Canada and contributing to economy. The belief that skilled immigrants are only those outside of Canada is so inaccurate and reflects flawed understanding of immigration, talent and labor potential.

Very few asylum seekers are qualifying for citizenship in 7 years. There are huge backlogs in both the asylum system and for protected people and refugees getting PR because the quota is fairly small given the volume of applicants. Many are taking ~6 years to get PR outside Quebec these days and processing times are increasing (and will keep increasing) for both asylum and getting PR. This also doesn’t factor in potentially applying for RAD and potentially JR. Don’t believe the 83% approval will continue going forward.

New to the page. It’s a tough battle out there from reading the comments and wish you all come out on the other side with success stories. I wanted to find out the chances for a new H&C application for a sibling who has been in Canada since 2021…for school then work and WP expired and was not able to successfully apply for other programs. Got diagnosed with stage 4 cancer right before WP expired and now on a visitor record and still needs treatment.

1) what are the chances for a H&C application, given I will be supporting them financially and they can be able to find work easily to support themselves given their educational background?

2) chances of getting health insurance?
I'm very sorry to hear about your sibling's illness.

1) That's going to be very difficult for any of us to guess. If your parents are deceased and there are no immediate family members in your home country, that will help. But overall hard to say.
2) I don't think it's possible to get health care coverage until you have AIP. I believe the wait for AIP is generally a couple of years. You will have to pay for the card and treatment out of pocket until then.

After two years, my father's H&C was refused, and he will be returning back home in the next three weeks (just booked his ticket).

MY father came here on visit visa 2019 to help me and my sibling settle, both of us got married eventually and i just became a Citizen this year. I have filed 3 years taxes as of this year so i will definitely share interests in sponsoring my parents. My father was continugin his stay here on his Visit Visa until last October they refused his extension of his Visitor Record (first time in 5 years) and i reapplied again with no answer. And H&C was filed in hopes of WP or PR in the meantime, of course it can take years we knew.

I do not know what will happen after he leaves, will he be banned as he has lived on for almost a year Out of Status.

He was helping me raise my daughter now 2, and we are expecting our second baby January, i wish my father was with me but IRCC has decided to separate his children from him along with his grandkids. For context my mother is back home and as been visiting us every year to see us and her grandkids and my father. My sister is waiting for her PR as well. My parents are old and we would like them to live with us than living alone back home.

EOI for PGP is unlikely to open for a few more years based on previous years. When/if it opens I would expect there will be hundreds of thousands competing for a small number of spots. Realistically your parents need to have a plan to remain in their home country longterm and you may eventually get lucky and be able to sponsor them. Your father should return home and after a few years can apply for a supervisa to visit your family in Canada. Impossible to say how IRCC will evaluate his application at that point.

He is not banned however it may be more difficult for him to return in the future as a visitor. This will not impact a PR application.

Can they access healthcare in their home country? Do they have family in their home country? Do you have the funds to pay for cancer treatment out of pocket? That could mean hundreds of thousands of dollars. Have you found a hospital/MD willing to take your sibling on as a patient? Some hospitals will not accept patients without provincial healthcare or other private insurance associated with their status in Canada. Given this is a preexisting condition private insurance is not an option. H&C processing is could take over a decade at this point although there likely will be reforms to the program because it is not functional at the moment. Your answers to the first set of questions may lead to faster processing (although I wouldn’t say fast). You also have to consider that your brother is unlikely to be able to work during treatment.
 
They cannot wipe out the entire backlog without Bill C2. However, I do not anticipate this bill passing in the foreseeable future. Also, cancelling genuine applications would be highly problematic, as this would trigger compensation lawsuits against IRCC versus targeting groups that are not eligible, such as parents/grandparents. I did read a lawyer's comment in the H and C FB group stating that Ukrainians in the inventory should be triaged to the refugee program. Not sure if IRCC can do that. I do not understand why many Ukrainians are applying for H and C (24K) in comparison to asylum. Most nationals of war-torn countries still apply for asylum and get approved. I strongly believe the Hong Kong pathway should not exist since it is a stable and prosperous country.

Proof that BIOC (even of a Canadian child) and establishment in Canada likely not enough to get H&C these days when it may have secure PR in the past. As I pointed out previously there will likely need to be additional H&C elements to get approved. It is an interesting read because it gives some insight on how H&C cases are being assessed these days. Of course H&C cases are subjective so we’ll need to see more cases to see if this is a pattern.

As for the best interest of their child, born in Canada, the Court finds that the Officer reviewed the evidence completely and reasonably, noting, amongst other elements, that the Applicants have three (3) other minor children still living in India, and that it would be in the child best interest to know his siblings.
