Hi. I am Mandy and I've gone through your forums and they are extremely helpful.
We got immigration to Canada and landed in Canada in June 2011. We applied for health cards, SIN numbers and opened our bank accounts. Due to ill health of my in laws. My husband took me and my kids aged daughter 13 and my son 10 years back to India in July 2011.
He tried his best and returned back to Canada and took all of us back to Canada in September 2012. My kids started their school there. Again due to parental pressure and as my father-in-law was diagnosed with cancer, we all moved back on 31st December paying heavy costs, depressed but as a family, we had to.
Now my daughter is a major aged 20 years and son also a major 18 years. They want to go back and start their study in Canada. Me and my husband also agree for that, since my father-in-law is 85 years of age, none of us as parents would go.
From your other replies I understand that they have a good chance to be granted travel documents
Please suggest me what to do.

There is a good chance they could apply for a PRTD under H&C, but no guarantee. Your daughter would need to apply soon as she’s reaching the upper limit for age consideration.

Thanks for your reply. Shall I apply for both of my kids together or shall I apply for them separately. Any idea, what upper age limit is considered for the kids under H&C category.

They should apply separately.

There is no official upper age limit. Those who are above 21 seem to almost always be refused. For those who are already 21, there are some approvals but seem to be a lot of refusals lately. We have seen some refusals at 20 years old as well. Your daughter should apply asap (before she turns 21).

I need to ask one more question! How much time it takes to get approval for PRTD under H&C grounds.

It can take months.....there in no set timeline. Your daughters application will be processed and considered separately.

It was a big mistake for your daughter to delay in applying. If she applies now, she will be 21 when the app is reviewed and has a very good chance of being refused.

What does this mean? This is for my son's PRTD.

The PRTD of my son has been denied.
I have an appeal time of 60 days. What shall I do. Do you take up such cases?
Either you appeal it yourself or you hire an immigration lawyer to do it for you.
