If the charge is under the criminal code, it will still be a criminal conviction. Doesn't matter what the charge is - as long as it is a criminal conviction, as far as I understand it, CIC may refuse admission.

Your lawyer should be advising you about the impact of this on your immigration. If your lawyer only knows criminal law and not immigration law, you should also consult an immigration lawyer.

Your PPR should have clearly indicated the deadline by which you must submit your passport; once you receive your COPR, it should clearly indicate the date by which you must land. If you do not land by that date, you will have to start all over...
 
If you get Absolute or Conditional discharge, you won't be inadmissible.
 
All you can do right now is work as hard as you can to have the charges dropped.

Don't try to land before the charges are dropped and you have the paperwork that proves so.
Completely unrelated. But I was charged with theft under 5000, first offence. Court date coming up in 2 weeks and I have to perform landing in 4 weeks. I am praying for the best case scenario to have the charges dropped/withdrawn on the first appearance (I have a lawyer). If that happens, can I still do the landing processes? What advice can you give me? THanks in advance!!

You won't be able to land if the charges are still outstanding. You need to do whatever you can to have the charges dropped at the first hearing.

Thank you! My hearing is in a few days and let's say best case scenario (charges get dropped) happens on the first hearing, in that case how do I proceed? How do I answer the criminal charge/conviction question they'll ask me?
