Hi Folks!

Is it true that FSW is extending until April 2015? I saw some replies on the forum but couldn't find it anywhere on the CIC website...

It's a rumor but No wonder if they do it lately because cic is good for doing such sloppy things. They don't understand or bother that it can be someone's life changing process.anyway if even they extend ( can't afford to start in time ) than no extra benefit that we would get because overall cap which is 25,000 very likely to be filled by December

So far is a rumor, in the CIC website cleary says "These are the last applications we will accept under the current system before Express Entry launches in January 2015." http://www.cic.gc.ca/english/immigrate/skilled/apply-how.asp

Maybe people got confused with QSW because applications end on March 2015 and new rules will apply on April 2015 people can still apply until march 2015 if the are part of the PEQ program or with a job offer because the 6500 caps are already gone.

It's not a rumor it is the truth.

The official instructions CIC MUST follow are contained in the Ministerial Instructions. The Ministerial Instruction governing the current FSW program clearly states that it will be open until April 30, 2015.

The web site of CIC is confusing because it seems to say that the program will end when Express Entry begins. But the Ministerial Instruction clearly states that the two programs will run in parallel until April 30, 2015. CIC does not have any discretion regarding this, their instructions come from above (the Ministry).

Nope - not necessarily. CIC gave themselves an out and can certainly decide to stop accepting applications before April 30, 2015. As usual, the devil is in the details...

From the Ministerial Instructions (see the part I have bolded):

...until April 30, 2015, unless otherwise indicated in a future Ministerial Instruction.

So all they would have to do is issue a new Ministerial Instruction and change the date.

Yes it is true. But a Ministerial Instruction can always change the rules immediately and without notice and without recourse for anyone affected. They don't need to leave themselves an out in order to do that--just ask all the pre-2010 FSW applicants whose applications were cancelled. :eek: :eek: :eek:

Also it is not CIC who issues the Ministerial Instructions, so they can't just issue a new one. CIC is under the Ministry so it would need to be the Ministry to issue new MIs.

although this article is not from CIC but this website provides authentic information. I have not seen anywhere in the news/ updates which says that entries will be accepted by April 2015. if there is a link please provide to clarify all applicants.

someone on the other thread "FSW 2014 Applicants Timeline" said he called to confirm and was told it will extend till April 2015.

I think it is better to send your documents before January 1st though.I am striving hard to send mine by first week of December.

Today I asked an immigration consultant and as of today the operational Gazette #572 "rules" http://www.cic.gc.ca/english/resources/manuals/bulletins/2014/ob572.asp this means that applications for FSW WILL BE received until April 2015. However, the CIC website also says " As of May 1, 2014, there is an overall cap of 25,500 for new federal skilled worker applications. This includes a cap of 500 applications from PhD students. There are also sub-caps of 1,000 for each of the 50 eligible occupations. The caps do not affect people with a valid job offer. These are the last applications we will accept under the current system before Express Entry launches in January 2015." (http://www.cic.gc.ca/english/immigrate/skilled/apply-how.asp)

As you can see, this could be a little bit confusing, and in the experience of this specific immigration consultant and also what says in the gazette is that this rule may be replaced at any moment by a new rule published in a new Gazette; therefore, the recommendation is to apply as soon as possible because rules may change.
Also many NOC's will be filled BY December or before.

I have already REPEATEDLY provided the link which points to the OFFICIAL INSTRUCTIONS from the Ministry which CIC MUST follow.

This is Ministerial Instruction 12, which CLEARLY states that FSW runs to April 30, 2015 and CLEARLY states that FSW and Express Entry will run in parallel from the time Express Entry begins on January 1, 2015 and the time FSW ends on April 30, 2015.

Please confirm if the deadline for submission under FSWP 2014 is 31st Dec 2014 or 30 Apr 2015, as on the CIC website it now says

"Ministerial Instructions 15 (MI15): Instructions for Managing Certain Permanent Resident Applications in the Economic Class

Effective January 1, 2015, the fifteenth set of Ministerial Instructions (MI15) will repeal all processing eligibility criteria (including the application caps and eligible occupation lists) for new applications in the Federal Skilled Worker Class, Federal Skilled Trades Class and the Canadian Experience Class. This repeal will not affect the actual processing of applications received prior to January 1, 2015, and considered under MI12. From January 1 onwards application intake will be governed by the criteria for the new Express Entry application management system.

MI15 will renew the pauses on the receipt of new applications for the Federal Immigrant Investor Class and the Federal Entrepreneur Class. These pauses will remain in effect until further notice."

It's definitely December 31st as most of us suspected it would be. This has now been officially announced by CIC. Ignore the posts above that give the April date. They are wrong.
