Just reach an immigration lawyer ASAP and he will better assist you. This surely not gonna be a first case, so they must know on how to go about it. As a starter, you can even call David Cohen?
 
IDOIT...Well I dont know if it will help to resend the application at this stage, YOU ARE RIGHT NEXT DOOR, so it shouldn't cost much. However lets remember that you are already halfway to the dream as you currently work in Canada, you can try to apply through the arranged employment option, which has no cap limit. Thy this with your current employer, if it doesn't work, you are in the very best position to find an employer who will go ahead with it (already have Canadian experience and already in Canada)

This is not legal opinion, just my view:
1) If you have a copy of your IELTS (reasonable date gap between IELTS test and 13-May), you could say "I am not stupid to send the app without the IELTS if I had already passed the test. I had the results way before my app date (13 May). Here is the extra copy to prove".
2) You could ask the CIC officer who checked your app to back you? But she will have to go against her employer which might not be in her interests.

Either way, any legal action you take will be a while before it is resolved. You may have to give up this cycle of FSWP. However, if you win the case, they can give you a spot in retrospect. So, I leave it to you. Perhaps you do a deal with a lawyer on a "no-win, no fee" basis. This would at least ensure you do not waste more money if legal action does not work out. Hope this helps but I totally feel for you. You are a great guy and you deserve better.
 
If CIC has an email address/fax number you can access, you could go with this route, i saw it posted in a forum once when a lady was denied for a invalid reason. She wrote a few emails/faxes to CIC, with the name of the person who signed her refusal letter, the letter was very respectful, non aggressive and to the point. It stated that X mistake was made by the officer and she had her copies ,I believe, to prove it and asked that they revisit her file. Miracle of miracles they did and she got her Per.

Just another option.

Thing is I wouldn't even imagine my app being returned yet being returned for such mundane reason!

God, I hate lawyers and their stupid laws!

haha, I called 1 (800) 242-2100 instead of 888 number and a chocolate company picked up I was like what. CIC moved ;) just kidding.

Hi Idoit - I am really sorry to hear that this has happened to you. I am a lawyer (but by no means a Canadian Immigration lawyer!) and I would say that Islandbabe has hit upon the crucial issue already - do you have any form of proof that your IELTS doc was included? In this regard ideally you are talking about a complete photocopied copy of your application including the IELTS docs (ideally the photocopy would also be somehow dated [although I am not sure how this would be possible]). The issue here is proof and you are at a great disadvantage unfortunately. I would agree with everyone who has said to get in touch with an immigration lawyer asap (I can give you the name of someone if you like?) and/or consider your other options are you are already in Canada. I would be surprised if anyone would agree a no win/ no fee deal (lawyers do not tend to be all that nice hence why I rarely admit I am one [I am nice I promise!]) but you never know. Good luck!!!

Sorry to hear this, I think you should call them right away to register your complaint. Don't know how much would it help to call the Call center, but who knows it might actually work?

On a separate note, it means they have started working on May 13th Apps.

Idoit, I am so sorry to hear about your file but I second Islandbabe's suggestion. The quickest way is to approach them gently through email/fax and prove your case by providing whatever evidence you have in this case by giving them copy of your IELTS and also point out how this was a mistake happened at CIO level. Simultaneously, you can seek any legal advise also. Do not wait. Approach them ASAP and in fact you might need to keep sending them several reminders in order to draw their attention. I feel this is doable. go for it.
