Hello, I would like to ask again everyone's opinion about my case. This is under spousal sponsorship outland. We submitted our application last September 2016. Sometime in March this year, we received a Procedural Fairness Letter saying that the sponsored applicant is criminally inadmissible due to a dismissed case 17 years ago. He was not convicted, sentenced, arrested or found guilty. The complainant dismissed the case due to misapprehension of facts or meaning it was all a lie. The applicants police clearance clearly states that He has NO CRIMINAL RECORD. Last April, we sent the submissions in response to
fairness letter. We submitted everything including court documents and a detailed explanation about the case. Last June 4, we checked Ecas and it is already Decision Made. We do not know how long the DM has been there because it was our first time to check online status. We waited for PPR or even a rejection letter but it is almost 3 weeks and nothing from the VO. Until early this week we checked Ecas again ang now it say IN PROCESS from Decision Made.

From Decision Made to In Process is it really possible?

Anyone please help me understand what is going on. Your help is highly appreciated.

This is an outland application, The MP, can still help even the file has been transferred to VO? Sorry i just don't know what to do. Thank you!

It is a part of their job to assist constituents in dealing with federal agencies. IRCC is IRCC regardless of where in the world they are.

Hello, Its me again and i have another question. We expect a refusal in connection with the fairness letter. More than 2 months after sending submissions in response to fairness letter, we received an email from the Visa Office this week asking for the Police Certificate that we already sent early this year they said they havent received it yet . So we re sent it again the other day. The applicant has NO criminal record. Any idea what happens next? Is this normal that after submissions to fairness letter they ask for PC? Is this a good sign? Thanks

Could be a good sign, however, no guarantees. Usually a good response to the fairness letter gives you a chance to defend yourself from inadmissibility issues, and I believe you provided them a good reason not to deny your app right out based on your explanation to them. How did you send the new PCC? As earlier stated, order your notes and/or seek the assistance of your MP.

We sent it via email. We sent it already before through webform and email too but they said they have not received it. We are still under the processing times, so still possible to seek MP's assistance? Thank you for your quick reply.

How about sending it by mail? Should be a good option to send it by mail. Which one is your local VO?

Of course, it's possible to seek MP's assistance anytime. It depends on the MP though if they will take you seriously or just brush you off, eh? Sometimes they do not entertain applicants under 12 months processing times, but should be worth trying, especially your case is not usual.

I don't know much about VO Manila but I suggest just to mail the PCC if CIC is asking for an original PCC and make sure it's the most recent one.
