Family sponsorship

Hello,

Just a general question regarding family class sponsorship. My brother is a citizen here and he submitted an application to sponsor me and our parents in 2009. Till now there has been no reply, but we believe it will take 2 more years to process the application. Here is the problem, since then I have done my undergrad and now have a job so practically I am no longer dependent. Do you think I have no chance? I am working under noc code 1311 and can no longer apply under CEC. It is very tough and am worried I would have to leave by next year (my work permit expires june 2015). Please advise.

Your school or employment is irrelevant and doesn't matter to your PR app under your parents. As long as you don't get married or become common-law, you will always be classified as type A dependent based on the date your application was submitted. It doesn't matter how old you get before getting visa.

Thank you Rob. I went to a lawyer and he said it is not possible. I don't know what his assumptions were. I was enrolled in a university in Ontario when my brother applied for sponsorship for my parents and me. I was not paying my fee at all. Living with my brother too. Now I am working at a company in Ontario under NOC 1311 after completing my undergrad.

Right now the application says received and I am worried if I am rejected then I don't have a back-up plan. If I enroll in CPA designation does that count as a graduate level program?

Your lawyer sounds like an idiot.

If you were 19 when the app was submitted, then you are locked in for life as a Type A dependent. If you are a student or full time worker, is completely irrelevant. Even if the application takes 10 years and you are 29 when it's done, you'll still be a Type A dependent based on the age the app was submitted.

The ONLY thing that will cause you to be cancelled from the application, is if you get married or become common-law with someone.

Nice to hear from you Karolina. My application was submitted in 2009 and the article states they are eliminating applications prior to feb 2008. I think I am safe but not ruling out the possibility of something unusual happening.
