i have came across the following issues in the forms: for PGWP Holders

Q= Was a positive Labour Market Information Assessment (LMIA) issued for the job offer in Canada?
A= No

Q= Is XYZ currently working in Canada?
A= Yes

Q= Does XYZ have a valid work permit for the current job in Canada?
A= Yes ??

Q= Is XYZ's job offer from the employer named on the current work permit?
A= No

Q= Four digit NOC code of current work permit
A= ?????

Q= Was a positive Labour Market Information Assessment (LMIA) issued for the current work permit?
A= No

What you guys did in the above questions? it is not accepting the form if i leave the Four digit NOC code of current work permit selection blank.

Since it is a dropdown menu with NOC codes, I entered the NOC code of my current job, which is also the one I am claiming for qualifying work experience

It won't let you write N/A?

Your answer for the first question should be no. If you don't have LMIA, that means you don't have a qualified job offer.

Phil89: i disagree

the question was

Does XYZ have a job offer in Canada?
i do have. (but its not an LMIA based job )

further down it ask for

Information about the Labour Market Information Assessment
Was a positive Labour Market Information Assessment (LMIA) issued for the job offer in Canada?

i said NO. as there isn't

these two are separate questions .....

The first question clearly mentions permanent/non-seasonal requirement, and later adds LMIA condition! So I agree with you!

I feel like the question should be more like "Do you have a job offer supported by LMIA?"

In the case of PGWP .. we say No. Then move on to the next question.

No, as it's an OWP,

therefore you could do any job wou wanted!

BUT, the way they made the tool, I figured my only option was to use that NOC code

(that option shouldn't be available though for OWP holders, as obviously they know that NOC code is not written on permit,
plus they will see that based on UCI from current work permit)

It's up to you to agree or not...

A valid job offer has to be:

- for continuous, paid, full-time work (at least 30 hours a week)
- for work that is permanent and not seasonal
- skill type 0, or skill levels A or B of the 2011 National Occupational Classification (NOC)

and either:

a- the employer making you the job offer must have a positive Labour Market Impact Assessment from Employment and Social Development Canada OR

b- you are currently working in Canada in a NOC 0, A or B job on a work permit that was issued based on a Labour Market Impact Assessment

So if you don't have LMIA, your job offer will not be accepted. Of course you could still answer "YES" and choose your NOC shown on your work permit (which is in your case a misrepresentation) but you will not be granted 600 points as you don't have LMIA!

Job Offer........
Pre-Assessed..
Further clarification:

PGWP holders are temporary foreign workers here. They don't need an LMIA to work here. BUT LMIA-exempt job offer won't be accepted as a valid job offer in Express Entry.

So, you can work for the duration of your PGWP in a LMIA-exempt job and then go back to your country OR get a LMIA job for that job points to be counted in Express Entry.
