Good day,

I have a query and would appreciate an advice. My family and I landed in Canada in 2010 as immigrants. We stayed there for 30 days and then left Canada for personal reasons and didn't go back. Our PRs expired in 2015. We are now wanting to go back to Canada and settle there. Can we re-enter Canada and reinitiate our permanent status? What is the best legal way to do it?

Or shall we start the immigration process again with a new application for skilled workers?

If you want to try to keep your current status, you'll need to fly to the US and re-enter Canada by land. If you are not reported at the border for failing to meet RO, you'll need to remain in Canada without leaving for two years straight before you'll be able to renew your PR cards. If you are reported at the border, you'll have to appear at a hearing to argue why you should be able to keep PR and can expect PR to be revoked and be told to leave Canada unless you have very strong H&C reasons for having remained outside of Canada for so long. Note that education and employment reasons aren't accepted.

Yes - you can certainly apply again from scratch. You will have to apply to officially renounce your PR status first. Note that the rules to apply for PR have changed quite significantly over the years - so you'll want to research the process to see what it now takes to qualify.

Thanks. How can we revoke our PR status? Any form to be filled and submitted? Can we do this process at the Canadian embassy in the country where we are currently residing in?
