Hi there! Happy new year to everybody! May God Bless us all!

I need advise please! After the CBSA caught me working in my husbands business while im holding work permit under LCP on July 2011 they ask me to report every first wednesday of the month which i always comply. After i was caught me and my husband got married and pass the application for sponsorship.
I came today was hoping to get a good news, they ask me to wait and someone will talk to me. honestly i never thought thf person from ministers delegate. She asn me about the allegation to me. And verify some details after that she gave a paper it says exclusion order. Now i really dont whats going to happen next. Do i need to get a lawyer or what? Should i proceed of going back home and withdraw my application here! Please help me. ThAnk you so much

Sorry to hear that but how were you caught working if you have a work permit? My only advice would be to talk to a good immigration lawyer.

This is a serious problem! Sad but you have very less chances left. :(
 
Was it an open work permit (allows you to work anywhere), or was it a work permit that allows you to work with a specific employer only? That's what I would like to know?

If it's the former, you'll want a good immigration lawyer. But, if it's the latter, I wish you luck, but it seems your options are highly limited. :(

LCP is a Live in Caregiver permit. She was only authorized to work in this capacity. The work she did for her husband's business was therefore illegal.
 
Ahh. That explains it all.

Yep. She's toast. (don't know a nicer way to put it) :(

The specific definition of the exclusion order is as follows:

Exclusion order: A person who has been removed as a result of an exclusion order cannot return to Canada for one year unless the written permission of the CBSA is obtained. However, people who are issued exclusion orders for misrepresentation cannot return for two years without written authorization from the CBSA.
 
Sorry to be the bearer of bad news, but if you've violated your work permit by working at your husband's business, instead of what you're legally allowed to do, you'll likely be ordered to leave Canada.

Furthermore, an exclusion order means you'll be barred from re-entering Canada for at least one year afterwards.

I know some one on a work permit running a side business, is it legal??
 
Might technically not be, depending on his/her permit.

Well the permit is restricted and only can work for one employer as specified.

Those work permits are usually pretty strict as to who the employer is, so technically they can't do any other business. In this woman's case my only advice would be to get a professional help/advice.
 
I keep reading about an 'open work permit', or at least it seems to be an option for those applying for PR from within Canada at least.

But there is one thing that keeps boggling my mind. If working contrary to their permit is a big no-no, then what's wrong with volunteering?
Another thing that makes me curious is how marrying your husband and having him sponsor her after getting caught is even going to help their situation? The circumstances involved might raise red flags all over their PR application, not to mention that she will have to tell CIC on the PR app about this immigration violation! (if she didn't mention that incident in the app, she'll be in even more trouble!)

I don't want to be hard on this woman, but she really painted herself in a corner here!

Yeah, for sure it will raise red flags for CIC because they even got married after the fact she was caught not before, they might scrutinize their app even more for genuineness of the marriage.
 
Thanks for all the comments and advice. He is my employer in my LCP providing care for his ex common law children. Were not in relationship before i apply for work permit but time passed and we had each others back as couple.i have two kids from my husband! We are planning to get married as soon i complete my LCP supposed to be december 2011 but someone called and report me before it happens. What makes me sad is about my kids. I have 16 months girl and 4 months boy and i know how hard to be away from a father even for a while. Oh God Please help me!
