I find it interesting that CIC managed to discover the first marriage but did not manage to discover a matching divorce. I wonder where it was discovered from? The OP has not actually confirmed that the first marriage has in fact ended with either a divorce or annulment. There is lots of mention of multiple wives being permitted, but not of there currently being only one.

Just a question for curiosity -for spouse ,the background check should be done before medical received or later on!!! My ecase says-medical have been received.that means they already done the background check or not yet..?

Background checks are done towards the end, as I understand it. It's probably an expensive process and would only be done once everything else looks good.

They said to me privately that is was a Muslim divorce just like it was Muslim marriage.
Muslim divorce is Verbal. They are allowed to practice those customs in their own regions.

Mynboi, I would base your argument NOT on the fact that you're allowed to have plural marriage. They will not like it. I would base it on the fact that the first marriage was not registered and it was made and dissolved in a traditional or tribal manner.

Yes, whatever you do don't listen to what all the Pakistanis did! Those people obviously tried to trick the system. There's a reason their processing time is so long :D :D :D

And some kind of documentation of the ending of the marriage would be very helpful.

i would like to thanks everyone for sharing their positive inputs....my husband went to see a sharia lawyer to help him out resolve the problem.... i was also dont understand why the NSO releases AOM or Advisory of Marriage if my husband's status still married from the previous one?we submitted original Marriage Certificate from National Statistic's Office and also requested AOM and all were released and no record found that he was married before?

When he wrote his previous residence on the form, they will run a background check for that town. It must be in the city records somehow. Perhaps he had an incident with the police with her name on the record somehow? Something had to be on somebody's file.

Did your husband had AIP before the VO discover his previous marriage or after ? Maybe the first wife has been sponsored by somebody else in canada or did try already to apply for canadian visa and there is a record in the canadian embassy where she put the husband info or she called the embassy to reveal them her marriage in 1990 with your husband or if she knows your husband's application is in process
or else there is no way for the vo to find the first marriage since there is no record in NSO database ,I migh be wrong

Hello everyone, i hope someone can help me with my current issue. I just started applying as a skilled worker in canada, my worry is that my husband was separated to his first wife more than 10 years ago but was not able to annul the marriage. Will this affect our application as a family even if im the principal applicant?

If you are claiming to be "married" it will.

CIC will not accept you being married if your "husband" wasn't/isn't legally free to marry you. And yes, they WILL check.

If, on the other hand, you are claiming to be "common-law partners", then it shouldn't.
