I tried soft landing last week at Peace bridge but was denied. They are allowing in only if you are coming in to live permanently. Unfortunately, I have to do the car export formality to be allowed to drive in. Please let me know if anyone recently drove in to Canada with own US car without car export-import formalities.
I think they didnt allow you to import the car but allowed you to land, right? i am trying to see if they actually denied or just didnt allow to import the car. Did you arrive for softlanding?
Most officers wont allow importing as its of no use importing if you are not going to actually move.

do we have an option at the border like 'if they deny we can come back to usa' or 'once we go to border there is no other way to take a u turn unless officer agrees to it'?

You would know if you are denied only after border officer processes your entry. You wont know/assume that you are denied unless you are told by the officer. if denied then definitely they will ask to take U turn only, they dont have other option.

Why do you think you would be denied?

if denied just tell cbp that you were not allowed for so and so reason. Even i was told to take U turn since i was not carrying negative test report(i was not denied since i am PR) but cbp will ask why we came back quickly and then we have to wait either in the car/room till they allow inside US. Denial processing takes time at both border is the only headache.

Hello,

I am currently in the US with a approved H1B visa (valid I-797) but have not been able to get it stamped on my passport yet. I also have a valid COPR which is about to expire in May 2021. The IRCC website states that, people living in the US with a valid COPR can travel to Canada to settle permanently, however I am not ready to permanently relocate to Canada. In this case what are my options ?

I know the US consulates are not open for H1B visa appointments. There is the option of AVR, but how risky is this ?

Can I risk travelling to Canada for my landing stamp and try to return back to the US on the same day using the AVR ? Is the AVR valid only for land crossing or both Air/Land ?

Finally, anyone else stuck in a similar situation ?

Thanks,

Did you do your soft landing?
Were you bale use avr?
any issues you had come across?

thank you hariraj, this is my situation,
- i booked airbnb for 14 days and in case if i am allowed uturn i will cancel it and would lose money for the first day's charges
- I am planning to take rental car from detroit so that in case i am not allowed u turn, i will return it at windsor and take another vehicle while coming from windsor to detroit after quarantine ( not sure if it works)
- I have i797 approved and my wife has valid visa stamping but only until september i am
not seeing if there could be an issue while returning back but not sure
Do you think any problems with points 2 and 3?

1. if you are not allowed to take u turn just after landing then you would quarantine for 14 days and then come in same car to US. Why do you want to return in windsor and take another car to US?
2. Its fine as long as I797 has more than 3 months of validity. If you are asked on what you would do after september then you can tell if you are extending the period through your employer or departing to your country etc.
3. No issues as long as you have valid I94. Do you have and till what date?

Is this case for you or for your wife? For both the above situation applies as all need to have valid I94.

- i read here or another thread where it is advised to not take own car but take rental car. That was just a frugal thought to save money to return in windsor as rental itself is turning out to be $1500 for 14 days. Initially i was thinking of taking own car, please advise
- My I797 is valid until next year and it is from my new employer, my wife is on h4 and her and my visa stamp is valid until september,2021
- Just verified the i94 and saw that it is valid until september 2021.

1. Take your own car to avoid additional huge expense. if you are soft landing then you can take your car. If you move permanently then you should be importing the car. They would have mentioned to take rental just to avoid explanation at the border.
2. Does she have I797 till next year? if not the border guys might ask why hers not extended till next year. So tell that you would be requesting after entering US.
3. Whose? your wife's?

yes, sorry you are right. Hers only valid visa stamp and i94 until september, but her h4 extension is not started yet. We are planning to do it in June, For me, i have i797 until next year and visa&i94 until september.
So as long as i take my own car and say to
them that i would return back it should be fine right?

They did not allow me to softland. I never tried for car import anyway as I was not planning to move permanently that day. They told me that car import happens at a different border and not Peace Bridge. But I am not sure what would happen if I end up at Peace Bridge without doing doing the export procedure and come in to land permanently. May be they will say I cannot do the landing as I have not exported my car. Not sure though.
