Closed WP NOC vs PR NOC

I have been working in Canada for last 6 months on closed work permit with LMIA exempt code C12 under title of ' C12-GATS Intra-company transfers- R205(a)'.
I want to apply for PR application and my NOC code is matching with 2171 as per my current and previous roles and responsibilities.
But I noticed that when my company (same company I was working for in India and am currently working for in Canada) applied for my closed work permit, it was with NOC code of 2174.
Can you please tell me if I allowed to apply with new NOC code (2171 in this case) or do I have to apply with same code for which my closed work permit was applied against?
Will really appreciate your help.

+ bumping up the post, I have the same question. Does it matter if I choose a different NOC to apply for my PR.

Go with the same code as what you have in your work permit.
Reason is that when case analyst review your application, FOSS (Field Operational Support System)/ GCMS integrated search, they will find out what is your current status, WP validity date, your NOC code under which you are granted to work. If you declare another NOC code for your work for same period, it might get considered be violation of your WP conditions. So it is better to align your NOC code with what you have in your WP.

Unfortunately my situation gets worse...I applied over a year ago... when I was applying my company’s HR department confirmed and provided all the letters based on NOC1122. Given that it had been a LONG time...I ordered and got my GCMS notes, and yes, they mention the FOSS/GCMS, where my WP has always been 0124. Apparently my HR department and the immigration lawyers who did all the work for my WP weren’t aligned and now am under RR for this reason. The immigration lawyers suggest they create a letter to explain a situation about the miscommunication between them and HR, so I can submit via CSE.. am not sure if this would solve this issue.. do you have any thoughts on this??? Any help at this point is very appreciated.

Sorry to hear about your situation. It is hard to say how case officer will evaluate based on your explanation. I would say stick with your WP NOC code and explain that NOC code selected in PR application is incorrect and needs to be changed to 0124. Because saying it other way around would means you will end up saying that you performed roles that was not authorized by your WP which can become a major red flag.

Another thing, when filing WP application, your company would have provided a letter of support indicating your roles and responsibility with which your immigration lawyer would have filed under NOC 0124. Does that roles & responsibility letter indicates same content what they provided to you for PR application under NOC 1122? If yes, probably you can mention in your explanation letter that the code was incorrectly selected as both codes share similar kind of responsibility, and indicate that experience letter submitted with your PR application align with the supporting letter that was filed for your WP application.

I'm currently on Employer specific WP (Intra Company). My actual designation was Senior Tester and job duties matched with 2283(Skill Level B)-Information systems testing technicians and based on that I have provided in the EE profile which is in submitted status.

But my WPs are approved under 2174NOC.I have realized this after submitting my PR application :(.I'm not sure what we can do here now.

Can someone please advise on this.

Couple of question:
1, will that be an issue during EE profile verification?
2, My reference letter and roles are matching to 2283 code.
?

Most likely this is going to catch their attention, though can't say if it will be an issue. I am from testing background as well, and my company filed by WP under 2174. So I submitted my PR under same 2174 code as well. And why it will impact because, i had ordered GCMS notes during the waiting period and in that, I noticed the case processing agent while reviewing my application for eligibility had made notes that contained below statement:
INTEGRATED SEARCH (FOSS/GCMS): PA: WP Valid until: 2019-03-13 (LMIA Exempt: C12, NOC 2174).

So they do see your WP details. Though you submitted experience letter that aligns to 2283 code, may be including the Canadian work experience, they may not count itbecause you were not entitled to take up any other occupation as closed WP prohibits it. You can submit webform I believe and resubmit your experience and reference doc in authorized WP NOC code. I am sure there are lot of people in this forum who in past has submitted application with "incorrect" NOC code. They can probably guide.

Not that I experience this first hand. But I’ve seen a post before, not in this forum though, where the PR NOC was different from the working holiday NOC. IRCC officer issued a procedural fairness letter asking PA why the working holiday NOC was selected, so PA with the help of her colleagues and her employer drafted a letter why the PR NOC is suitable. The NOC used was related to horse wrangling, two different NOCs (One is B while the other one is C) but related. So I guess it will all depend on the officer who’ll review your case.

I agree with @NOC98 . May be better to wait because you do not want to complicate your application by submitting anything preemptively. I would say, once you cross 3 month, you may want to get gcms notes to find out what's happening so that you can prepare accordingly.

Hi All, I urgently need help. So I am working in Canada on a closed work permit since Feb 2019.

While applying for my work permit and work permit extension, my employer has used the NOC Code 2171. Unfortunately, I was unaware of this at the time of submitting my Express Entry application. Moreover I could not find NOC code mentioned on any of my work permit or any other document which were used in the process of submitting my work permit application.

While creating my Express Entry profile I applied for NOC code 2173 because as per my understanding my job duties which are mentioned in my roles and responsibilites letter for my Canada job assignment matched more closely to the ones which are described for NOC Code 2173 rather than NOC Code 2171.

I got to know about 2171 yesterday from my consultant when I was going through my forms for TRV process for my work permit.

This is really urgent and I am planning to submit a webform telling IRCC that I filled 2173 by mistake.

Can you please help me with your inputs and what should I do next. I believe this is a huge blunder from my side

Similar thing happened to me, I did check with my lawyer.He said it ok and as it is not going under unskilled NOC
