Hi guys, well I have received my confirmation through the post! Only issue though is that they have not given me any papers relating my son. I have sent them an email but they haven't got back to me yet. My son is 3, is that the reason he hasn't recieved any paperwork?

Is your son already a citizen or permanent resident?

If not, you must absolutely sort this out before landing.

Is he listed as a dependant in your PR papers (confirmation of permanent residence)?

Be aware that there are legal provisions that could prevent you from ever bringing your son to Canada in future, if you become a PR and CIC considers you to have failed to declare your son.

No, they haven't listed him, he was on all of the application papers as required.

Is your child a Canadian citizen? I mean, if he's your wife's son, and she's Canadian, he probably is. There are some exceptions, however.

According to all the paperwork, even though his mother is Canadian by birth, as he was born in the UK, he would have to go through the same process as me.

That depends. If she was a Canadian citizen at birth, and she was born in Canada, then he is also a citizen, barring extremely unusual circumstances.

Would have thought that too but they asked for money to put his application through...?

Was your wife born in Canada?

Yes, and her parents, grandparents, and great grandparents :)

Okay, I can already guess the answer to the following question, but were either of her parents diplomatic staff for a foreign country at the time of her birth? (I'm guessing no.)

You're good at this guessing game :-)

No they are your everyday working Canadians.

Okay, is your wife the biological mother of your son? Or did she adopt him?

Biological

I can't see any reason that your son isn't already a Canadian citizen. You should look into getting a passport for him, with urgent processing.

I imagine the visa office realized this, and this might be the reason you don't have papers for him. Contact them to confirm this.

In case this is wrong, do the following when you land, if your son doesn't already have a passport. Make sure you declare your son as a dependant to the border officer, saying that you have applied for a passport for him, but don't yet have proof of citizenship. Don't sign the COPR where it says you don't have any dependants. You should try entering from the U.S. so if you're turned back at the border because of this "change", you'll have somewhere to go.

By the way, your son will be a "second-class" citizen of Canada, thanks to our Tory government. He won't be able to pass on Canadian citizenship to his children born outside Canada the way your wife has (probably) passed hers on to him. This will be the case even if he lives in Canada for the rest of his life, but has a child while on vacation with the mother.
