I received a refusal for my Canadian Experience application:
I am not satisfied that you meet the official language proficiency requirement(s) because the IELTS test scores required to meet Canadian benchmark of 7 are as follows: 6 for Listening, 6 for Reading, 6 for Writing, and 6 for Speaking. Your IELTS test results indicate you scored 5.5 for writing. Therefore, your language test results do not meet the required language proficiency for skill level A.
Subsection 11(1) of the Act states that a foreign national must, before entering Canada, apply to an officer for a visa or for any other document required by the Regulations. The visa or document may be issued if, following an examination, the officer is satisfied that the foreign national is not inadmissible and meets the requirements of this Act (including requirements of the Regulations made under the Act).
Following an examination of your application, I am not satisfied that you meet the requirements of the Act and Regulations for the reasons explained above. I am therefore refusing your application. "
The Ielts score, It was my mistake.
I emailed the officer asking to wait until get a new IELTS result with 6 in each band score. No answer.
I got my IELTS in a month and submitted it to CIC with a request of reconsideration letter, this is what I got today:
This refers to your recent correspondence received at our office requesting reconsideration for your Application for Permanent Residence in Canada under the Canadian Experience Class.
Your application for Permanent Residence in Canada was considered on its substantive merits according to the applicable section of the Immigration and Refugee Protection Act and was refused. Your request for reconsideration has been reviewed and I am not exercising my discretion to re-open this file as the information provided does not change my original decision.
Now, can anybody help me if it is better to challenge the officer's decision ( if I may do so at all) or file a whole new application and pay the processing fees again?
Considering the fact that my Work Permit expires in January 2015 and I don't wanna leave Canada and wait for my PR while outside.
Any thoughts would be greatly appreciated.
