Hi please help me i need some advise.

I have sponsored my wife with the new rules. She came on Nov.2014, one month later she kick me on the face and left the house, at that moment i called the police.

Some months later she returned (i think because she didn't have money) was with me for some weeks and let the home again.

now i have to solve this, i don't think she deserves to stay here, she has a boyfriend (i think since the first departure) now i have to pay her welfare, lawyer and fees.. (use to pay all her needs before coming here for 3 years)..

i see on the law that if she left me she have to leave Canada (some friend told me she's visiting a psychologist to show that i treated her in bad way, that's not true!!). Border Services said it's not easy because i have to prove some kind of fraud.

What can i do? :(

If she’s already a PR then only if you prove she obtain in fraudulent then CIC might take the right course of action. TO MY UNDERSTANDING, if she legally obtained her PR status then she legally permanent residence despite the domestic issue between the two of you.

I would go seek a family/ migration lawyer; you would have to pay a consultation fee, but at the end it will give you legal advice on what you need to do.

If she has Condition 51 (conditional PR), then she's required to live with you for 2 years after becoming a PR. If you've broken up and she's moved out, your first step should be to report the breakup to CIC. They will investigate her PR status. Those violating conditional PR rules can possibly have their PR revoked regardless if there was fraud or not.

If she's playing against me getting psychological advise inventing all bad things about me, how can i defend myself? i don't want she obtains Permanent residence. She destroyed me and played with me, i put lot of money in this for some years. Should we said this is fraud? maybe she was looking to stay here since the beginning? obvious she will Deni it! their PR status will be revoked FOR SURE regardless if there was fraud or not???? didn't know that part..thought FRAUD is the main key to get the PR revoked...

here what makes me angry is to know we CITIZENS are helpless in almost these cases.. on the sponsored book you can see a paragraph that said you can't tolerate abuse from your sponsor. What about us sponsors? we have to live with all kinds of abuse? paying taxes to the Federal government and the sponsored can stay legally? this think makes me throw up!!!!
 
Report to CIC exactly what happened. If you know her to have another boyfriend, tell them that as well. It would be good if you can prove it. Aside from that, there is not much you can do except see a lawyer to ask about how you can protect yourself against abuse charges and whether you should file for divorce at this point.
 
Your very first step is to officially report the breakdown to CIC. Without doing that, you can be guaranteed nothing will happen. You say she landed in Nov 2014, so later this year her conditional status is gone and you will be completely out of luck.
