Hi, I am Kiran, I have applied to the BC PNP program 3 months back. a few days back I have received an email from the BC immigration officer stating they have concerns about my profile.
1. at the time of application I have chosen Job NOC code 1212"Supervisors finance and insurance office workers", in the email that they mentioned that the title"Accounts Payable Specialist" on my job offer is not matching, and they also called my HR and asked whether I supervise any employee and my HR said no. I agree the title is not matching with the NOC code title but I perform most of the duties and responsibilities mentioned in the NOC 1212 and the same was mentioned on my Job Description letter. Now my lawyer is telling us we will write a clear explanation and provide the letter of explanation signed by my manager and head of HR and also they want to mention that HR business partner is not completely aware of my responsibilities what I will perform in the company.

I just want to know what will be my chances of getting approval in this case ? is this a normal case or a rare one.

Please suggest.

Honestly no one can tell you your chances. Your lawyer is the best guide since you have one. The NOC is a supervisor position so if you don’t manage anyone it may not be your NOC.

But i train and monitor new employees which comes under supervisory responsibilities , if my manager and head HR signs on explanation letter does it impact my approval chances ?

Can’t say. Officers may have another NOC in mind.
Officer have shown another code with the title , but my responsibilities and duties are matching with 1212. When officer had called my HR told I do not supervise but she is not completely aware of my responsibilities.

So your HR department doesn’t know what you do when they are in charge of staffing and hiring. That doesn’t look good.

That’s the problem here , they only hire people but responsibilities and duties are given by my manager, also, my manager had signed the job description. Only job offer form was signed by HR. I am assuming that we can justify that HR is not aware of my responsibilities and duties .

Have your manager and HR send the letter in explaining your duties. I would also make sure that letter states how many people report directly to you so that you can clearly show you have supervisory duties. Hopefully that will be enough. Good luck.

I have asked my lawyer to prepare an explanation letter PFL so that my HR and Manager can sign . And I am hoping that my case will be approved .

No, it's not. What matters is the job duties.

The problem here is when the office had called my SR HR BP she said I do not supervise any employee based on my job title but 80% of my roles and responsibilities are matching with NOC 1212, now if my HR head and my managers provide an explanation stating that HR does not involve in day to day activities of employees thus HR is not completely aware of the duties. Also, my manager has signed the job description letter, offer letter, and recommendation letter earlier. With this do I have better approval chances?

"It was my understanding that Kiran’s application was on hold due to his job title not matching NOV 1212. I am Kiran’s immediate manager. After careful review of the NOC description, I feel that while his title does not have “supervisor” in it, he performs some duties described in the guide. He acts as the lead for the Employee expenses side of AP and has been tasked to train the new hire, as well as organize the work for the AP team amongst themselves. I have attached an updated job description that is more representative of the duties and tasks he performs now. Kiran has been a valuable member of our team and we would like him to continue his employment with us. Attached are some documents as proof and evidence for some of the supervisory activities he performs for the team." This is the explanation my manager is ready to provide, does this improve my chances ?
