According ro my agecny I just need to wait from my employer
To buy me a ticket, but until now there's no feedback.
Is this the reason? Even if u already got lmo and visa still it holds you.
I'm under Tim Hortons supposedly from Philippines

Was this as a DIRECT result of the moratorium, or were there other factors? Can you offer a citation for this information?

This kind of thing has been going on forever. In completely different industries too. Like when they shutdown the TFW program for "adult dancers" (aka strippers) when the strip clubs were filled with dancers from eastern europe and CIC found that strip clubs were abusing the TFW program and favoring the foreign dancers over local Canadian ones and the dancers were being taken advantage of by the businesses. The strip clubs complained that no one wants to see "lazy, unattractive local girls" over the foreign east european girls and banning the program would hurt both business and customer. But the argument didn't fly and the strip clubs are still around and still making money gouging customers with overpriced alcohol.

This power play even exists outside the TFW. Unions always opposed private sector businesses using non-union labour and viewed it as stealing union jobs and driving down wages. Just look at the whole Staples vs Post Office union workers fight in the US. It is no wonder that the food services union here is supporting the ban on the TFW. But it is nothing against foreigners. They are opposed to any non-union labour - Canadian or not.

We have the same situation here mine is February of this year, but until now I'm still waiting for my ticket. My agency told me that the employer did not reply yet to their email.

As you must know already, the Canadian Government has just made more changes to the Temporary Foreign Worker Program and has temporarily stopped processing LMOs for the Food Service Industry. At this time, no Restaurants, Fast Food Restaurants, Food Outlets or Coffee Shops can receive LMOs.
People working in restaurants and food outlets which are part of a hotel and are operated by the hotel should be fine. Meaning that the Hotel and Lodging Industry and other industries like Retail are still able to get LMOs as usual.
To help you with this, I will have an “Open Discussion Session” on the most recent changes to the Temporary Foreign Worker Program.
The session will be next week in Banff. You do not need to register; just come to the meeting with your questions and concerns for an evening of discussion.
Date: Tuesday April 29, 2014
Time: 6:00 pm to 8:00 pm
Where: Town of Banff, Council Chamber
Cost: FREE

I did. I actually had it printed along with that NOC2006 and 2011. Because I will be seeing my lawyer tomorrow. But I found that announcement in Facebook. Someone is actually saying otherwise. I am really confused. Not sure what the lawyer is going to tell me tomorrow. If she will be giving me other options or she just want to tell me that we can't do anything else right now but wait. :(

Temporary Foreign Worker Program - Moratorium
The Temporary Foreign Worker Program is a program of last and limited resort, to be accessed by employers facing genuine, acute labour shortages, and only after Canadians are not available to fill the job. In support of this Program mandate, on December 31, 2013 , the Minister of ESDC issued three Ministerial Instructions, one of which is the Refusal to Process Labour Market Opinions (LMO) if there is new information indicating that the employment of the foreign national in any portion, sector, region or occupational group of the labour market in Canada may or will have a significant negative effect on the Canadian labour market.

After careful analysis of significant new information, including from Canadians through Service Canada’s Confidential Tip Line, the Minister of ESDC has directed officials to establish a moratorium on the Food Services Sector’s access to the Temporary Foreign Worker Program.

Effective immediately, ESDC will no longer process LMOs for occupations in the Food Services Sector.

LMOs will not be processed for occupations classified by the 2002 North American Industrial Classification System (NAICS 2002) in Food Services and Drinking Places (NAICS subsector 722). Specifically, certain occupations related to sales and service and sales and service management as set out in the National Occupational Classification (NOC 2006). Please see this list for further detail.

Employers that have submitted applications and paid the processing fee, but have not yet received an LMO, will be refunded the full processing fee.

Any unused positions on positive LMOs that have been issued to employers for these sectors will be suspended and therefore will no longer be able to be used to obtain a worker permit.

ESDC will continue to ensure that Canadians have first access to available jobs. Abuse of the Temporary Foreign Worker Program will not be tolerated. To report misuse or abuse, contact:

I don't know how you see it but in my eyes, even if the program could be improved (as anything always can actually), it did cover all the bases everyone keeps complaining about. The fact that employers abused the program by not following those agreed terms are not because the program is not good but because the government and all relevant authorities were unable to actually make those checks and punish the employers who didn't comply.

In other words, when you make an agreement and someone cheats, punish the cheater, don't blame the actual agreement. Also, if you believe that a country the size of Canada with the economy it has and its current population, with its current growth rate, won't be needing foreign workers to keep up with this growth, then I suggest not only ending the program but kicking out of the country all current TFWs to see how fun it will get all over the country in no time.

Let me see if I can answer your points. Two years ago the government made the programme more attractive to companies saying that they could pay 15%less than the average wage in the job. Suddenly thousand of temp workers were hired and Canadian residents were pushed aside. There was uproar when various companies started laying off their workers and hiring TFW, so it was cancelled, Since then we have had obvious transgressions, most recently the 58 year old woman who was fired after 28 years service so that her job could be given to a TFW. You don't do that kind Canada and get away with it

What the government has realised, because the C D Howe Institute told them, is that allowing TFW in unchecked is depressing wages, at a time when average median wages should have gone up by 3%, they have gone up by less than 2%, and unemployment in the west is 3.8% higher than it should be.

So the arguement is that TFWs are increasing unemployment and depressing wages. Let me illustrate that. Cara Operations,who operate such roadhouse style restaurants as Milestones and Kelseys are seeking Chefs at $20/25PH (salaried). These are restaurants where all the ordering is done according to a set plan, and the chef basically has no discretion in what is served. Good restaurants where the chef is required to have superior skills, staffing,ordering, menu planning etc would probably be looking at a minimum twice that amount, say $70/80 thousand per annum. I suspect most of you who are chefs are being offered maybe $12/13PH.

This why there is a problem, because you are right, a chef will not take a job at $13 when he knows he is worth, and can get twice that amount.

No one is blaming TFW, we are blaming companies who are trying to get cheap labour, at the same time as they are denying Canadian residents jobs
