IMO the best course of action is as Jimmy has suggested. Send a fax stating you believe they have made an error, and send as much further proof of your relationship to your brother as possible. Be sure to double check the exact requirements on your visa-office specific check list.

Has your brother been a permanent resident for at least 1 year (before the date of your application)?

LMO and TWP are 2 different things, for me for exmaple I got an LMO valid for 3 years, but my VISA and TWP have 18 months validity because of my passport expiry date. So when my TWP expires, I will re-apply only for a VISA and TWP with the same LMO.

PNPvsFSW, you have to check your LMO expiry date before going through the painful process of obtaining a new one.

I think TWP is totally independent from the AOR/PER, they are parallel processes, you have to make sure you have new TWP before the old expires regardless of the status of you PR application.
 
guys.................. i told you before i had a bad feeling..i was a feeling that something bad is coming .. yes.... it was... i checked my email after 2 days ...

"your application is refused due to insufficient points"

i claimed 67 points in my assessment but they assigned me only 62. no points were awarded due to insufficient evidence to establish a relationship to a relative living in Canada.
i calimed that my spouse has an uncle living there for 30 yrs till now with all supporting documents .. but unfortunately visa officer refused to accept that .........

oh God help me... i am stuck in the middle of nowhere ... nothing was discussed about refund in email ... although my BD was encashed in September..

i dont know why 2 similar cases about adaptability of "having relative in Canada" refuses back to back ...

now i lost hope :-[ :-X :'(

Nope. All we're heard from visa offices are "your papers are in transit", or a few ppl have been wrongly told that they need to send all their docs to them within 120 days (i.e. the old system not the new system).

Sorry to hear that i think you should email them and ask for explanation and try to apply again we had the same problem with one our friend in the arabic forum they also calculated 22 point in education instead of 25 and this make him so angry but he send them an inquiry and he will apply again

Sorry to hear your bad news Zint. I am also awaiting news from them. A friend of mine and I applied on the same day and she received her PER already. I am still waiting. I don't know what the problem is, I have a diploma as well as a degree in pharmacy. Not sure which one will take be used to calculate my points. So the wait continues. : :-[ :-[-[

I have no idea why we are still waiting, Wayne. We have plenty of points and of course the LMO is proof of the job being legitimate, so I cannot think why we haven't been approved already.
The main problem for us is finding out why we are still waiting. Neil was on the telephone for over an hour to CIO yesterday and they went and saw his file and returned saying there was nothing wrong with our application and it was being processed.
We are now the longest wait of anyone on the tracker who is still in the running, I think. We are absolutely baffled and so upset to be so far behind.
The LMO renewal needs to be done in exactly the same way as the old one - same advertising requirements and all the rest of it. My OH should be fine because his job is so specialised and the software this company use is completely unique to them, so there won't be any other applicant that can claim direct experience in it anyway. Neil will have a year of experience working with it! The company are very happy with him and committed to him staying so that, coupled with the very specific nature of the work, should ensure that there is no problem with renewal.
It is a bit of a faff, though and more expense for the company.
Sad to hear people being rejected.

Hi, hmm good question. This is just something I was told somewhere on this forum I think, but not 100% sure? Most other things to do with family (sponsorship etc) require the family member to have been resident in Canada for at least 1 year.

So :( to hear about zint file returned, now seeing that CIO is digging up the application not providing PER for couple of weeks instead reducing points by any means. i am scared and worried about my file. I got 70points from my calculation with the relative adaptabilty but now ???????? ???
Folks, i send my uncle's citizenship proof with utility bill..the proof of resident there in canada and for proof of family relation i send a relationship certificate that mentions about my whole family but again this certificate was prepared by my brother so it shows main applicant's name . Applicant(brother name) XXXX, Father of applicant ..YYYY, Uncle of applicant ZZZZ, Brother(MYself) AAAA. stating that from all the poof provided the following members are the relatives of the applicant as mentioned above.
Do u think this certificate could be a proof for proving my relative there in canada? Experts and other who applied with relatives please put ur advise andsuggestions.....

This would be an interesting development, if true.
Could you elaborate, as clearly as possible:
A) what evidence did you submit for proof of qualifying relationship to applicants uncle?

Also, just curious and irrelevant to above Q., did you apply by yourself or hired an immigration law firm/counsel?

I tend to think that you and the other applicant simply did not provide sufficient evidence and it will be apparent to you if you take a closer look at requirements and what was submitted along with your app.
