I feel like I am reading my own story.
The only difference is I got laid off before I applied for PR.
AINP never withdrew my application. But it was still too risky to apply and might end up in wasting time and 550 dollars.

I called CIC at that time asking for an open work permit and they said that my current work permit must be 4 months or less to expire as a must. Also PR application must be after the first phase.
So the answer is NO, But these agents have proven many times to mislead.

If this is the only option you have
Maybe write them a cover letter saying that If they do not give you a work permit, you will go for Employment Insurance what is inconvenient for all parties.

Just my two cents. Hopefully, others will advise more.

I think its my story..My NOC is 2113 too..and like byrus I lost 100k offer due to not having PR STATUS..
yes i will try to write a cover letter and try for BOWP..

Really though, if you're having 100 grand thrown your way, surely there are other opportunities available to you?

Geologist NOC 2113

IF you're sure you qualify under CEC, it's usually faster, but hopefully you realize you likely also qualify under the Federal Skilled Workers class -

Thanks jes_ON,
but too late now. Applied under CEC and got the stage 1 approval yesterday. And if it's faster anyway, then even better. Adavntages if I would have applied under the Federal skilled workers class???

Has anybody problems with the "Application to change conditions, extend my stay or remain in Canada as a worker" document, IMM5710E???
I put in my information and I want to apply for an Open Work Permit. Page 1, Question 3: I am applying for one of the following: none of it fits me!!!! Not the same and not a new employer, I am unemployed right now! I can't validate the form... anybody any tips, please???? Thanks a lot guys!!!!

Find an employer who has a ready lmo so you can apply for a new work permit. That is the reason most foreign worker move to diff provinces to be able to find another job when they get laid off.

thanks for the tip but I need help on something else right now.... as stated above

Choose "new employer".

As you've noted, you have to choose one of the options. For open permits it doesn't really matter which one, as the employer section will be left blank anyway. The form is used for any kind of work permit application from within Canada. The question should have been phrased better, but basically it's asking "is this an extension or not". You're getting a new permit, not an extension, whichever option you choose, but again it doesn't matter.

Thanks LPS. I tried every option they give me and it all sucks.
If I choose 'new employer', they want the address and name of the new employer. If I leave it blank I can't validate the form and won't get the barcodes. I will call them tomorrow and see what the person from the CIC hotline says (I don't trust these guys at all)...

Weird. As soon as you select "Open Work Permit" as the permit type, the employer and occupation details (questions 2 thru 7) in the "Details of intended work in Canada" section should become optional. Are you using the latest version of the form? (November 2013)
