Dear Altruists, I just wanted to know that if for any reason, the appeal is dismissed or anybody loses in the appeal process, can that person resubmit the sponsorship application curing the defects for which the application was initially dismissed? Any reply along with reference is highly appreciated.

You got your ADR for December 20 last year, do you already have your visa since then or still waiting?
He just submitted updated forms,police clearances, etc last April 2017 and also waiting for passport request like me and a few people in the forum. Sorry, I answered for his behalf.
 
Hello everyone

If some one win the appeal for spouse sponsorship in mid of April from Toronto , what is further process? And how long it will take time to sponsor spouse from India.

Lawer say only 2-3 months only , is it true?
 
So we filed our appeal appx June 2015. As much as I wanted to make it happen faster I could not. However, Feb. 23 my lawyer was notified that IAD had a morning slot open May 9th. Did we want it. I said absolutely. So we prepped our book. Dropped off proof n photos n bills etc. Was feeling good about our chance for testimony. My husband and I went over lawyers questions. Original refusal reasons. Age, religion, & culture differences.
All in all it took two hours. The CBSA officer's opinion was to set aside refusal and allow appeal. The Ministers Asst Deputy also agreed and told us congratulations! So she was to immediately notify visa office to continue processing application. I got emotional of course. They wished us luck. All nice ppl. The security officer as well.

Congratulations! That's absolutely good news. You have to start doing your police clearances now because this one takes time.
When I had my full hearing, the judge was very nice and the Minister's counsel did not gave us a hard time. My sponsor told me that within 5 minutes of the Hearing he knew that the judge was on our side.

I contacted the IAD office yesterday to know the position of my file and when we ll get the bluebook. I submitted appeal in january 16, 2017 and i also understand that it takes 120 there about to get ur record (bluebook) right now its almost 120 days so i called to inquire about it, the rep surprisingly told me that we should expect it around july 6 since the request was made in march 6,2017. Please the ones with good knowledge of the workings can you confirm this if its true.

Thanks so much. My husband already has a new one. We are thinking of doing the medical in the next few weeks. I don't know about the first 5 minutes. Not much to tell. But her & I had the same name. We only had 3 hours alloted but just needed 2. They broke early for lunch.

Your next option is go to the Federal court if your appeal was dismissed. You can reapply if something significant happened in your relationship because if you just submit the same kind of evidence there is a chance the visa officer will refuse your application again.
But so far most of the people who appealed especially in this thread were successful at the ADR and Full Hearing.

In my case, Bluebook did not arrive in 120 days. If I remember right, my sponsor filed an Appeal, June 2015, and our Bluebook came November 2015.
 
Our blue book came after 141 days. Two days before Rememberance Day. But I blame the election.

Finally!!!!!!!!!!! After three(3) long years of waiting,.,.,.,., I GOT PASSPORT REQUEST.
