Yes we did submit our documents. they have send us the letter supposedly on Oct 27 but we did not receive it till november 17 i think it was. We have send all the documents in early December. Our visa office was Paris but we were asked to send our documents to ottawa for processing and as far as i know that is where they are being processed. They told my MP that my husbands file has passed the medical and crim check and In mid March was send for security checks...they did not give us any time framework.

Hi everyone.

You can see general info regarding my situation in description.

I had an interview on may 2014 in visa office.

From what I gathered, the work that was done by my lawyer (who took me for 6700$ dollars) was not done correctly.

Shortly, i lived xommon law with mt wife for two and a half years prior to marrying right before my exclusion order. Apparently visa officer stated to me that though the amount of proof exceeds that they require they cant grant me permit.

Later on in june 2014 i got a refusal letter and applied for appeal. Had to change my lawyer for a better one, who told me my first one totally screwed up.

The first lawyer told me that the appeal date is may 2017 but second one was able to move the date to may-june this year (we still have not heard anything in regards to exact date is)

Its been three long years of waiting for me and my wife and its been totally horrible.

Heres to hope I win my appeal. Does anyone know how much longer after that it takes?

hey there oneness, our timeline is quite close. Won appeal in Dec, 2015, got medical and updated forms request in April, sent them to cic ottawa end of April, now my e-case still doesn't show Medical Result has been received yet? only says they started processing my case in april, 2016, nothing about medical, even i did it early April. How about your e-case? anything mentioned about medical ? Thank you and good luck.

I received our GCSM notes Friday and it confirms that we were denied on the grounds that my husband could not answer all the questions he was asked so our marriage was deemed not genuine. I filed for an appeal Apr 4,2016. So should receive Blue Book in July approx 120 days from file date.

According to the notes my husband provided limited information regarding my habits. relatives;and life in general.

In the denial letter it was stated that when asked what my status was when we met he said I was divorced ( which is correct) and the agent said no she was a widow ( which is incorrect).

He was asked a lot of questions about his previous common law relationship that ended 7 yrs ago and she is living in Germany. Asked about when I last traveled to Cuba. where we stayed in Cuba when I was there. Asked when we met and where and why we waited 2 yrs before marrying.

One of the questions he was asked was if I had any medical conditions and He told them I was a diabetic however when asked the names of my medication he did not know the medical names. He was asked what kind of a diabetic I was and he did not know. He could not pronounce my grand daughters name which is Charisma. He was also asked what I do an a daily bases and could not tell them.He told them I was a retired school teacher from a College and that I traveled to Cuba and Africa. He was also asked why he wanted to be with a woman 13 years older than him. He answered that to their satisfaction. The agent asked when I was divorced and he told them however the agent says no she is a widow ( which I am not). He told them that my Mother lives in Nova Scotia and my Son is married and works in Alberta. Also that I have 3 sisters. In what language we communicate. Date we were married and what he will do in Canada. he answered all of these questions.

I am considering re applying and was wondering how I address the ones he could not answer.?

I have been gone for quite so long but now i am back with a great news...we won the appeal at last!!! It was such a long legal battle and we finally have proven the merit of our case. Quite few members in here were kinda negative that we will win our appeal case but me and my partner just keep going and being steadfast that we will make it in the end. After we lost the 1st appeal case, we never stopped. We seek for the another legal avenue where we can fight our case. We ended up filling before the Federal Court for leave and judicial review and we won the Federal. So our case was sent back to IAD for re determination and be heard by different member. We had our 2nd appeal case last March 21, 2016, we received the decision last June 4, 2016.

I am so happy the we finally won our appeal. Thank you for all the advice and comments. It made me strong to move forward and go for it. I have a question though, how long will it gonna take before i can finally get the visa? Hope to hear from anyone. :)

The part where they said you were a widow rather than a divorcee should be easily addressed, as its a clear mistake on their part, that you can easily prove them wrong.

However, I'd be more concerned about where they mentioned they asked him what you do on a daily basis, and you said he couldn't answer them. CIC might see that because he doesn't know your daily routines, he doesn't really care about being in this relationship with you. My suggestion would be trying to address this during the appeal as much as possible, as it's usually the "easy" questions like "What does your spouse do everyday?" "What's his job?" "Are his parents dead/alive?" where if the applicant can't even answer those, it raises more red flags than most others.

Thank you for your insight. Gives me another perspective. Gcsm notes or both at the hearing. Some people who have gone to an ADR tell me they ask questions totally unrelated to the reason for denial. I am also wondering where he could not answer these questions if they will go immediately to a full hearing. Any thoughts. I have no idea why he could not answer the daily questions as we have lived together and my daily routine is basically the same in Cuba as it is in Canada. Except in the winter I shovel a lot of snow LOL. which I don't do in Cuba. Either way it will mean I will have to travel to Montreal and the wait for a hearing can be 2-3 yrs where as if I re-apply it would be less and of course most likely an interview.

Sometimes they asked questions to throw you off track. A lot of people complain about how much the VO lies about the answers they received from the applicant.

It might be easier to go on with the appeal as opposed to reapplying...when you reapply you need to show some significant changes to your circumstances, you have to have a lot of new and more convincing evidence...when you appeal they will just ask you about the same issues you were denied on, plus you can submit all the new evidence you gather after the refusal...
