I just submitted a stack of documents requested by CIC in support of my application under the federal entrepreneur class and was wondering how long I should wait before applying for a fresh set of caips notes which will show data regarding these documents.

I'd suggest ordering them every four to six weeks until you see the documents show up.

hey guys just an update... after receiving my docs request in Dec 2011 I submitted my docs on March 12th.. Requested updated caips / gcms in mid-may but nothing showed up, however the due date (b/f date) changed from Nov 2012 to June 13th 2012.

I was wondering how long I should wait again before ordering a fresh set of notes that would show their interpretation of the documents that I submitted.

So many changes going on with the immigration system I am concerned that even though we've reached this far they may still choose not to finish processing the application. My original application was submitted in Oct 2007.

Just got a reply from the high commission. My application was originally sent Sept 2007 and they are saying that my business documents must be for the preiod 2002 - 2006. I submitted 2006 - 2010 which they say they cannot use. However the CIC website clearly states the following: Business experience in respect of an entrepreneur, means a minimum of two years of experience consisting of two one-year periods of experience in the management of a qualifying business and the control of a percentage of equity of the qualifying business during the period beginning five years before the date of application for a permanent resident visa and ending on the day a decision is made on the application.

Can anyone clarify this for me??

It sounds like the Visa office is exercising their discretion in this matter. If I were you, I'd comply with their request AND quote the specific section to them to point out they should be able to use your newer information as well as the older information.

Thanks computer geek... the thing is that in my country we are only required by law to maintain company records for a period of 6 years so I am not sure if my accountants have the documents that they are requesting, and because of how I interpreted the information on CIC's website I did not insist on keeping those older files..

Then perhaps you can provide other evidence that you managed the company during that period. I'm not sure what they have requested, but in my company, we have many years of annual reports that we submit to the government authority and that would demonstrate management/ownership, even if they did not demonstrate financial specifics.

Personally, I think the VO is misunderstanding the lock-in date rules (as you noted). But if you don't have the specific records, even more general records - such as a letter from your accountants stating they have been your accountants prior to 2006 - may have to do. It does seem a bit crazy for them to focus on 10 year old materials and ignore current materials, but the CIC processes don't always make sense to me, either.

Very helpful advise.. I too believe that they are not interpreting the rule clearly as I have had a similar problem with them last year where they quoted ministerial instructions that were not relevant to my case.

I will see what records I can get my hands on but at the same time I am thinking to reply to the VO requesting clarification based on the rule as quoted on the website.

I am a 2006 self employed applicant, I recently cancelled my application and sent a new one.
IMHO your case is a proof for me is that they are doing everythign they can to discourage older applicants, or to force us to cancel our applications.
they are trying their best to get rid of us.

Happy new year to all.

After submitting all of my documents in March 2012, and then an additional set of documents that they requested was submitted in August 2012, I have not heard anything from the VO since.

In their last request for the additional documents they ended by saying that when they receive these documents, the file would be sent to an officer for review.

Is it normal for this to take so long? Is there anything that I should do at this point.

My last set of GCMS was received end of November 2012 (dated 5th November) and it showed where they received the docs but not much else changed.

CIC is definitely slow. From what it sounds like, the file was awaiting review by an officer. You may wish to order another round of GCMS notes.

I was looking at some Open Data reports and found where 80% of applications under my category (Federal Entrepreneur) in Port of Spain were completed in 84 months (most recent report as at Oct 2012). On CIC's website they say that the processing times are calculated from the date they receive a complete application package.

My question, I applied using the simplified application process in 2007 and they requested all of my documents at the end of 2012, does that mean 84 months from when I applied in 2007 or am I looking potentially at another 6 years for my application to be finalized (84 months from the end of 2012)??? That would mean that my case took 11 years from the date I applied!!

Please reply if you can shed any light on this.

Got this from another forum.. thought it may be of interest to others:

According to data.gc.ca, the total number of of entrepreneur files as of October 6th was 2,501, of which 42 were in PoS. In the third quarter of 2012, CIC finalized 57 entrepreneur files while PoS finalized none.

The maximum 2013 quota for business class is 6,000, including 1,400 investors. Thus, only 4,600 entrepreneurs and self-employed applicants plus their dependants will be issued visas in 2013 out of the 6,146 files, consisting of 18,530 souls. Thus, if the Minister does not abolish these files, as he did with the 34-month inventory of skilled worker files, it will take four years to work through the current entrepreneur/self-employed inventory at the 2013 allocation.

It is difficult to project how PoS will handle your file. The 2012 "business class" target was 10 -- 2013 has not been released -- and includes entrepreneur, investor and self-employed.

As of October 6th, PoS had 69 such applications and had made selection decisions in only 5 of them. At ten per year, it will take seven years to work through the inventory, but, based on the third quarter, PoS is not even meeting that meager target.

I have an entrepreneur file we had perfected in July but have heard nothing further from PoS with respect to that file. So, I really cannot give you any encouragement that PoS will assess and finalize your file in your lifetime. Sorry.

If the Processing times were not depressing enough, the fact the Minister is considering cutting the backlog of Business visa applications by cancelling them is just bad news!

Yeah Lubs64, there truly is little encouragement no matter which way you turn.

I am hoping that PMM or one of the other more experienced guys can add their input, firstly to confirm if the information and interpretation provided by the person on the other forum is reliable and worth basing any decisions on.

It would be remise of me not to add that after following some of the other posts by the individual who provided that reply, he seems to have an overall very negative view of CIC and the whole process. Maybe I am just grasping at straws :'(
