How come you received the email so late? Anyway, Did you submit your docs altogether or when one is available? It is still weekend there so i will just send it by tomorrow night. :)

I am in US for the past more than 6 years working on H1B. I am an Indian national along with my wife. My son was born in US and is a US citizen.

Below is how I think I screwed up:
1. I applied to NSNP 2014 (without job offer). I had applied early enough but I had missed putting in the Visa office where I wanted my application to be processed in IM0008 (Q4). So I was contacted by an Officer and she asked me which visa office do I want to process my application.

2. My job situation is sort of ok but we never know when lightening can strike, so to be on safer side I filed "New Delhi" as my Visa office. A few days back the nomination paper arrived in email mentioning that my visa office is New Delhi.

3. Recently, I was reading some forums (specifically Reply #1095 on
Re: FSW 2014 Applicants Timeline- Lets Network Here. ) where one of the members (ashif_eee) mentioned that "Brother first of all since u r in US over one yr then as per rule ur VISA OFFICE will be CPC-OTTAWA not NY or in US VO...".
4. I did some more search and found that on CIC website that english/DEPARTMENT/media/notices/notice-buffalo.asp where it says:
"If you are an American or national of another country currently residing in the U.S. or Canada and want to submit a permanent resident application:

Economic Class applications must first be sent to the Centralized Intake Office in Sydney, Nova Scotia, Canada (CIO-S).... Applications that have been screened for positive eligibility will be sent directly to CIO-S or CPC-O for further processing. Applicants should indicate “CPC-O” as the processing office where indicated in their application."

I am not sure if this is true and if so, what can I do? Please guide me.

Yes, since you are in US for more than a year your VO is CPC-OTTAWA. Also, at present the fastest processing is done by CPC-OTTAWA. I would say you are lucky that you come under it.

But for the issue you have for NDVO, you can contact NS office and request them for file transfer to CPC-OTTAWA.
NS office has full control and your file can be transferred to CPC-OTTAWA.

I think its not a big issue, its just that you need to make few phone calls- either to NS OR ND office.

Some followup questions:

1. I have NOT send the federal application to CIC-NS(Sydney) office. Can I change the Visa office to CIS-Ottawa in the IMM008 (Q4) that I file with them. This would be inconsistent with the Nomination letter from Nova Scotia. Should I call the Nova Scoita Provinicial nomination office ?

2. I am ok keeping the visa office as New Delhi if this is as per the rule. But, do I have to travel to New Delhi for the medical or interviews ? (or can I get the medicals done locally in US (I see list of doctors in US on CIC website)? Also, how are the medical reports sent to the Visa office? (fax/email or some other mechanism?) Sorry I am completely new to all this.

3. I read that we will have to send passports etc. Do we have to send the passport to the chosen Visa office or can I get it done locally. I am ok traveling to India (rather than sending passport by post to New Delhi or even sending it to Ottawa (I don't know if I can personally travel to Ottawa). How is this generally done.

I quote you wrong, have u forgotten that a copy of his nomination will be sent to CIC? The best thing is to write to your case officer and explain everything to him so dat he can change your visa office in your nomination letter. You can't be writing ottawa as your visa office while your nomination letter is carring new dehi.

1)It is even better if you haven't sent your federal app yet. Firstly you need to make sure which VO you wanna proceed with either Ottawa OR ND. If ND then its fine the way it is, but if its Ottawa then first contact NS office to request for amendments on nominations letter.

2) Nope, medical can be done worldwide anywhere. Centers listed on CIC website. Some are e-enabled so they send report directly to CIC electronicaly and some hand over hard copy. E-enable are better anyways to keep things faster.

3) On final stage your local visa office will ask for passport. In most cases there are "no interview", so nearly no need for personal appearance. So either you send your passport with some close one traveling to India OR Canada for respective VO. You can also check withs VFS services, see if they accept your passport for their own courier service to the VO.
