Sponsoring my Common Law Partner separately from her Dependents

If they are legally in Canada they should be applying for study permits. If you list them as non-accompanying there is a good chance you will first get a PFL, if the VO is not happy with your response a refusal and if refused there is very high chance a 5 year ban. You should be very clear...

Sponsoring my Common Law Partner separately from her Dependents

IRCC overlooked inconsistencies, many misrepresentations, red flags, etc. all in the name of faster processing and more immigration. Many of the people who listed their spouses as non-accompanying for higher points are now getting PFLs or even letters after they got PR.

H&C Humanitarian Ground with/or Without Failed refugee claim

An active H&C case has never prevented removal. When numbers were low it was rarely enforced but that changed around 2 years ago. Canada is trying to reduce the amount of temporary residents and undocumented people so it is removing more people or making it clear that people have no options to...

H&C Humanitarian Ground with/or Without Failed refugee claim

H&C applications don’t prevent removal. You can read cases weekly of people with active H&C cases trying to stay their removals. Most are dismissed so will be removed. Others will leave on their own because it will increase their chance of being able to return. Until around 2 years ago most...

H&C Humanitarian Ground with/or Without Failed refugee claim

Protected people already have the right to remain in Canada unlike H&C applicants so a very different scenario and highly doubt there ever will be a 1 time policy. If there is a 1 time policy I would imagine it will be targeted to only Ukrainians and/or HK H&C program not the general program...

Sponsoring my Common Law Partner separately from her Dependents

It isn’t an option. IRCC lost their mind for a few years and stopped enforcing their own rules but that has now changed. If you don’t want to sponsor your spouse then don’t but you will have to include the children.

Overseas spouse and dependents of protected person and convention refugee timeline - Share here

Processing for dependents is slow and going to get longer as more protected people get PR. The 1 time policy gets the person in Canada faster Pr but creates backlogs outside of Canada.

H&C Humanitarian Ground with/or Without Failed refugee claim

That is because PR card processing isn’t tracked carefully like many forms of ID in Canada. Not the same. Forget mandamus if people really want to see change they should get together and take IRCC to court based on H&C no longer being a functional program. It is going to happen eventually. That...

H&C Humanitarian Ground with/or Without Failed refugee claim

What the processing time was when you applied is not relevant. If your processing time is somewhat similar to others then you won’t have grounds for mandamus. A writ of mandamus is only worth being pursued if your processing time is significantly longer than others who applied at the same...

Sponsoring my Common Law Partner separately from her Dependents

Do the children actually qualify for a study permit? If not living in Canada without status could create a variety of issues now and in the longterm for them. If they qualify for a study permit they should get a study permit. Have they been without status for almost 3 years? You can’t sponsor...

    General question for TRV

Really tough to predict whether you will have issues entering Canada. Telling the truth is your best option. You can show your partners proof of funds but will be up CBSA how much they consider it.

    Sowp after visitor record refusal

What will be refused? The SOWP? Not necessarily refused but put on hold until you get AIP if you are without status. If your status is restored you could be approved for an SOWP before AIP. You should try to restore your status to try to prevent removal. If your visitor record was denied I...

H&C Humanitarian Ground with/or Without Failed refugee claim

Your wait time has to exceed normal processing time by a significant amount so would not normally be a case for mandamus. Looking back you appear for have received AIP in mid 2025 so you are experiencing normal processing and that wouldn’t normally be a case where filing a writ of mandamus...

Sponsoring my Common Law Partner separately from her Dependents

Would add by listing the children as non-accompanying while in Canada you could also be denied due to misrepresentation which could also include a ban of 5 years. You appear to have done minimal research about immigration and should seek out the help of a professional if you are not able to...

Any benefit to reapplying for delayed dependent child study permits, or other remedies available?

Yes your processing times are not unusual and yes these applications are typically approved if the children qualify for study permits.

    Sowp after visitor record refusal

So it will be processed as submitted. Given you have no status in Canada you aren’t eligible for an SOWP until AIP of your sponsorship application. You have bigger issues as you don’t have status in Canada and can be removed. You should attempt to restore your status for a variety of reasons...

    General question for TRV

How long are you attempting to visit Canada? Why do you need to quit your job? That eliminates a significant tie to your home country.

    Sowp after visitor record refusal

    1. At this point only after AIP since you don’t have status in Canada. 3. After AIP yes although your whole timeline may raise red flags since there are more cases of marriages of convenience as people try to remain in Canada. 3. You should attempt to restore your status although there is no...

Any benefit to reapplying for delayed dependent child study permits, or other remedies available?

    1. You will just start from scratch and likely wait the same amount of time 2. Posted processing times are often not accurate and what you are experiencing is very normal processing time.
