a lawyer on LinkedIn said it’s better to request GCMS notes from CBSA rather than from IRCC or to do both because the CBSA is less of a mess...

As taxpayers let’s not tax the system even more which does lead to delays and pay twice for the same information. IRCC has been back to processing GCMS notes in around a month so there is no need to order both. Most H&C cases will see no movement in their files because the quotas are so low and there is a huge backlog of AIPs waiting to land. The system is no longer functional and by not closing the program to new applications the backlogs keep growing. The plan appears to be to remove people when they lose status and are waiting for their H&C to be processed based on the JRs I read.
 
It took less than a month for me but as I said no updates on it. It didn’t take that much time for them to prepare I believe in.
Also, you should know that the GCMS notes we receive are not the most up to date.
They reflect the status from the date you requested them, not from the day you actually receive them. (Another sign of IRCC’s inconsistency.)
I’d suggest maybe calling the call center, because some officers can be understanding and may help you with important information about your application, while others are just bitter and don’t want to bother.
As people who pay taxes, as well as huge amounts in tuition fees, housing, taxes, etc. all without benefiting from the full range of rights we would at least like to have a more efficient and professional government service !!!
This department is truly awful, and they keep saying they’re improving their services, but honestly, it’s all just talk !!!

Waiting for years for an application to be finalized is not reasonable. No one made this application for fun. The quotas they mention, or these long waiting times, do not seem humanitarian or compassionate at all.

I don’t understand the angle you are looking at this from, but for the people waiting, this situation is a complete limbo. You cannot start a family, you cannot buy a home, you cannot attend your own wedding celebrations, and if there is a funeral, you cannot even go to offer your condolences.

I know everything is slow in Canada, but this should be fast. It needs to be fast because people should be able to plan their own lives. Just because no one is looking or paying attention, so many people should not be left living in uncertainty.

I learned something, my friend sometimes people hold some ideas and simply refuse to change them a vision of the world, of society, immigration, the state, the nation, institutions, politics etc...and they refuse to reconsider it.... unfortunately they are narrow minded.
No matter what arguments you bring up, they just won’t understand. They live in a world of their own. I spent a lot of time in this forum explaining the situation of h&c, explaining that this kind of program is not unique to Canada and that many countries have similar mechanisms to regularize the status of immigrants in need. I talked about the foundations of Canadian administrative law and how it is poorly applied by many İRCC officers. I talked about the importance of not generalizing, of knowing how to distinguish between situations, of not putting everyone in the same basket, and about how the rigidity of the law can sometimes harm people facing serious circumstances...
But at some point, you realize that you’re talking to a… (Anyway, I’d rather not say lol...)
So in the end, it’s better to focus our energy on things that actually help us, supporting each others as h&c applicants figuring out how we can improve our situations and our cases, and maybe even shedding light on the backlog of humanitarian applications with the help of immigration law and human rights experts. We should mobilize people to encourage faster government action, because sooner or later, a solution will have to be found. Above all, we live in a country governed by the rule of law the Canadian state is not limited to IRCC....!!!!!
There’s obviously no point wasting time with people who have absolutely no role to play, whether positive or negative… just people who love hearing themselves talk.
İn LinkedIn, Immigration lawyers, public policy experts, people working in international law, people working in Canadian and international NGO and others like them have all addressed the disastrous situation at IRCC .Those are the people we should be listening to !
