There is an order. JR will be processed first if you apply for JR and H&C.
No need for argument but, three immigration lawyers with over 15 years experience can not be wrong all together.
Like I said, most important is for everyone to get positive decision in the end. I have submitted both application today (same day) will keep this forum updated as it goes.

Just one point to mention, immigration lawyers have a very strong financial incentive to encourage you to submit as many applications as possible, and to find you any possible argument, even the one that has 0.00001% probability of occurence, to continue pouring your $$$$ into this adventure. On the other hand, hundreds of applicants who are sharing here their real-life cases and actual experiences have nothing to ask from you. Good luck!

I agree with your submission completely and I appreciate fact that we are all doing our best here to help and lift the spirit of one another.
Like I have mentioned, the purpose for this first trail of this subject is not to raise argument or to create ambiguity. But I, like many of us have come to know that there is no one situation fits all in Canada immigration.
I have made further finding and I have narrowed down.

but I will like to know how does one know when they put one of the two application on hold. Is it by any means of communication or it shows on the application? There should be a way to be able to prove the assertion.

Thanks to everyone who have learnt his/her thoughts on this subject.

Thanks for sharing this experience. This makes sense and it’s meaningful to me. This is exactly what I am talking about. Every case is treated differently.

No, you will not get communication and you will not see on ECAS either. We could see in GCMS notes that the application went in process once JR was rejected. Nobody will tell you application is on hold, unless you have a very good relationship with your officer, your CBSA agent (if you have one) or your MP, who could follow up with IRCC on your behalf.

Because it will be in process until JR is decided.Never heard of getting AIP with a pending JR.Nobody’s trying to cause confusion here.we’re all sharing our real life experiences for others to learn.so you take it or leave it.Period!

Hi all, I’ll like to make clarification here on something I have read so much about on this forum and which prompts me to make research and I also speak with different immigration lawyers on same subject.

people here often say if you apply for JR and H&C at the same time that one will be on hold until decision is made on the other. This is NOT correct as I have clarification that they are treated separately and accordingly depending on when each application were submitted. One does not put the other on hold. JR is specifically legal review that goes straight to court and get attention of judges with communication between the counsel and the assigned judge while H&C goes directly to the H&C department of immigration which gets attention of H&C immigration officer.

what this means is that they are treated respectively but as soon as one reaches positive decision stage, the other is suspended or disregarded nonetheless, if one gets a negative decision, the other gets through its full process.

I hope this helps us to understand the processes much better especially those of us in this situation.

Hello, everyone, I called CIC two days ago about the status of my application he said still under final review and I will have the answer soon he told me the background check passed since September 10 could anyone please let me know why it is taking so long he told me everything good should receive COPR soon. Thank you for helping.

Final review took over two months for us. There was shortage of senior officers to sign off files and they had to mail it to a different office

I’m same like you I been waiting same time as you I’m in final review I check ecas 3 to 4 times a day if my ecas to decision made but still shows in process :oops:
