Hi,

I can't seem to find the answer for my potential situation.

- I've been in Canada (I'm Scottish) living with my partner (she's a Canadian citizen) for 18 months.
- During this time I've been on a Visitor Visa, extended twice with the Visitor Record.
- One year of living in our own home will be the 28th May, and on this day we will submit our Common Law application as we will have been living in our house for one year.
- My Visitor Record expires on May 30th.


However... If necessary quarantine is removed in Scotland in the next couple of months I'd really like to go home in June/July for a few weeks to visit for a few reasons. My mother has been badly ill and I've not been able to get back to see her being the main one.

The problem I have is, I need to apply for an extension to my Visitor Record, but what happens if I apply for an extension and then leave the country for a few weeks while it is being processed? When I return is the application for an extension removed? and a new visitor visa granted at the airport on arrival? or does having an application for an extension outstanding cause an issue with that?

My last extension request took just over 6 months for them to respond. I received my confirmation on May 2nd, with an expiry of May 30th. So I don't imagine they will reply about a new extension any time soon either.


I've checked that I can return to Canada, as long as I can show proof of my Common Law application and committed relationship it seems I can return, but as always the grey area of it being up to the border official to decide.

Just wondering more about submitting an extension, then leaving before an answer, and then returning?

Hope that makes some kind of sense, any help is greatly appreciated.

As soon as you leave the extension request becomes invalid. You should contact IRCC via webform and tell the, you have left to try and save any potential cost like having to do a medical. To return to Canada you will need to prove that you are in a common law relationship with a Canadian or PR. It will be viewed as a new visit. You may be questioned about your time in Canada because you aren’t truly a visitor. If asked I would provide proof that you have applied for sponsorship. You should be applying for outland sponsorship if you don’t plan on remaining in Canada throughout the whole sponsorship process.
