I called the IRB last week. No update and they told me that their time table is around 3 months. My case is in the Western Division.
You have to wait at least 6 weeks, and up to 8 weeks, its pretty normal. Even though the member decides right away, its gon take some time for the paperwork to be processed. I hope you'll hear a good news soon!

Hi folks,
I submitted my documents for file review in October,2020. After four months of waiting my lawyer got a call from RPD asking the same proof/documents they wanted in their letter of streaming of less complex file which I already submitted before. Still I give some additional documents and since then more than 1 month pass no news yet. I am little bit confused and frustrated. Why they are asking same documents again? Are they not satisfied with my previous documents? Anybody here was in the same situation? Is it a bad sign for my case? Please let me know your valuable thoughts. Thanks

Yeah, at my hearing, they told me that it would take them two weeks to process the paperwork once a decision is made. :/ Though, it was someone from the registry who told me this, so maybe it's a bit hopeful?

Hello everyone,
Today I received my positive decision electronically through my counsel.
My hearing was scheduled for March 13 and the member made her decision on March 18 and they sent the electronic version of the NOD to my counsel through MyCase Portal and mailed it to me and my counsel. I have not received the mail yet but I am going to apply for my health card and PR ASAP with this electronic version.
I hope everyone gets their positive decision soon.
Here the timeline for my case:
1. Made the claim in June 2019.
2. Got a "less complex" letter a few months later.
3. Then nothing until December 2019 when I called IRB and they said they have decided to have a short hearing.
4. Then Covid hit in March and nothing for almost 9 months later
5. 3 months ago I received a Notice to Appear letter.
6. March 13 was the hearing and the member did not make a decision. The fact that she did not make a decision at the hearing was extremely stressful.
7. I called IRB multiple times and first week after hearing they had no updates. Second week they said that they had a decision but sent it to a third party company for transcription. Third week I called they said to wait.
8. Finally I received the electronic NOD today April 6. So totally it took almost 3 weeks.

From the day I made a claim until today it took almost 1 year and 8 months.

Congratulation. We had our hearing on March 23 and positive decision were read to us... however we havent reveived NOD yet. We are still waiting, its been 8 business days.

Hello, my hearing is in 1st week of june. But my lawyer said he needs more time and wil ask to postpone, could anyone tell me how long would I have to wait once my hearing is postpone. I am in bc so heard it's quicker. So around a 1 month for new hearing?? Thanks.

My understanding is that hearing date is fixed depending on member and lawyer’s availability/schedule. If that is true then your lawyer confirmed 1st week of June but wants to postpone as he needs more time. Since you applied in 2018, i wonder what more time your counsel need, a week, month? To answer your question, im not sure how long you have to wait, and its not certain that it’ll be after 1 month. It depends on members next availability and your lawyer. You may wanna discuss with your lawyer about that.

Guys I first received the less complex letter then received the short hearing date, however my lawyer sent me that document that has been sent to the IRB once I have received the less complex letter but I noticed that my lawyer Haven't sent all the document I have sent to him!
I asked him and he was like unprepared for it and kept saying that they are a lot to read or that i don't need those documents but the IRB asked me for it to be honest!
and he was like alright i will read them again!

IS THAT OKAY or WHAT ?
I feel like my lawyer has no time for me though or i don't know what is wrong!
Ok, here is the deal:
I had the same situation like you. Getting this positive decision I got last month cost me to pay 2 lawyers in half and pay the third lawyer in full.
My first lawyer was one of the best but unfortunately he was so good he was invited by the IRB to become a member. I paid him half his fees and he left me in the cold.
I hired the second lawyer, she was just so dumb I let her go half way and paid her half her fees. This one was exactly like your lawyer! She DID NOT KNOW nothing about my case! Did not even look at my narrative!
I hired the third lawyer that I paid in full and she was very good. Not as excellent as the first one but really good. She was wise, understanding, precise and on time. I got my positive decision with her. She deserved every cent of that $3560 I paid.

With regard to your situation:
Do not worry. You still are able to submit all the remaining documents until 10 days before the hearing date. You got a hearing. That is a done deal, whether your lawyer messed the file-review up or not. You are essentially stuck with a hearing. So in my opinion after almost 2 years of dealing with lawyers: Try to concentrate on getting a responsive, resourceful and perseverant lawyer as soon as possible. Forget going to a hearing alone or with a dumb lawyer. You do not perform dental surgery on yourself by watching dental surgery YouTube videos, so winning a case at the hearing needs a professional lawyer who knows how to deal with RPD members.

Thanks for the replay bro but unfortunately I'm few days away from my hearing and my lawyer just sent me the list when the 10 days just passed :(
What makes me really worried is that my lawyer response with negative attitude to me when I asked him about why he didn't sent all the documents!
Like you don't need this or that and even saying that the documents are a lot etc...
I'm even more worried now after I have already passed the 10 days period!
What to do now :(
I don't think you can do anything now that the 10-day deadline has passed. I suggest you call IRB and ask them if there is a way to send in documents. Tell them the truth about your lawyer being incompetent and he forgot to send all docs.

I have important tips for you if your lawyer is dumb! Go read https://irb-cisr.gc.ca/en/country-information/ndp/Pages/index.aspx to know about the background and documents the US and Canada have about your home country. You can mention the reference to these NDP documents about your case at the end of your hearing. Members make an important part of their decision based on NDP.

I already read all the important information about my case on this site before even received the less complex letter and I have noted the important part of those pages and edited them to my lawyer so he can submit them to the IRB , but he didn't submitted them!
I work more than him , he doesn't do anything for me honestly
Also If i call the IRB and tell them what happened to me with my lawyer and that I already used this site to bring more evidences regarding my claim but lawyer didn't summited them and I knew late, do they do anything for me?

There is no need for submission of NDP. NDPs are NOT your personal evidence. You or your lawyer can talk about them almost at the end of the hearing. If you know about your NDPs specific to your home country this fact can help you alot at the end. Usually it is the lawyer's responsibility to talk about NDP at the end of the hearing.

Oh, if this is the case then that's good , at least half of my problems with my lawyer just solved.
Wish me luck bro, I do have every single evidence regarding my case though from A to Z , i hope my lawyer just do a good job at the hearing date, that's all i need, since he has a lot of evidences already.
If you have all the required evidence and you know your case in and out and from top to bottom you are going to win it. Just keep in mind NOT to contradict your self or talk long! Speak short as much as it is needed. My lawyer always told me NOT to volunteer information rather let the member ask and answer very specifically JUST the question.
I wish you good luck and success in winning your case. Stay positive and keep your calm.

Yes you can submit past 10days deadline. There was important document that was left out during translation, but my lawyer did submission 6days before scheduled hearing. She was confident because we were sending through soft copies and was ready incase if member asks why “late submission”, which she didnt.

I had to deal with two lawyers, first one was good but his office staff were the dumbest i have ever seen. He was later declared as “non-practising member” by the Bar after being charged by the CBSA for the Immigration offence. I got new lawyer, and she is the best.

im confident you’ll get positive decision, moving from file review to short hearing means they have few questions they want to ask. All the best

Dear Seniors and all members,

Today i had my 2nd hearing (virtual hearing) member was very kind and polite it lasted only 45 min including introduction and closing, apart of 2 question from Narrative member mainly focused on IFA which i replied in detail and then my lawyer submitted his remarks to cover everything regarding IFA she said she will send me answer soon.

How do you see this, is it positive?
