You can file your your study visa and SOWP, they will be processed on its own merits. It will have no bearing on your PR application.

As per subsection 22(2) of the Immigration and Refugee Protection Act dual intent is allowed

Dual intent

(2) An intention by a foreign national to become a permanent resident does not preclude them from becoming a temporary resident if the officer is satisfied that they will leave Canada by the end of the period authorized for their stay.

Each application, PR / TRV is processed on its own merits. Just because you have an application in processing, does not mean that if you file another unrelated application, it will take longer.

Also, you cannot add a fiancé, you have to be married or a common law partner to apply for SOWP.

Hey folks, wanted to ask if medical expires after one year from the date the medical was done or the date the medical was passed. In my case example I gave my medical in March 2020 and it was passed on my profile in May 2020, when will it expire- march or may?
Date medical report was received by IRCC - usually around 10 business days after you did your medicals. So yours will expire this month, or April.

Hi all,
First, I am grateful for this forum. Thank you all! It is the one thing that has been helpful during this trying time of endless wait without any reasonable justification from IRCC.

I am CEC (inland) AOR Mar 4 2020. Like some of the others on this forum, my application is stuck and the Webform responses are generic messages. I called IRCC few times and the agents told me that my application is "waiting to be finalized". When I asked agents say that it means it is waiting for a visa officer to finalize the application (whatever that means). The application has been "waiting to be finalized" for at least six months when I first called IRCC.

My life situation is difficult as it is and this indefinite wait is making it much worse.

I have reached out to my MP, they said they'll reach out to IRCC to get an update but I am not sure if IRCC will give them a generic reply too. I also reached out to the minister of immigration but got a vague automated message, not even sure if they'll look at my request.

I have ordered GCMS notes, about 30 days ago, still waiting to receive them.

I have also submitted a compliant against IRCC under "Services > Processing Procedures" that they need to at-least provide a meaningful updates to Webform requests and when applications will be finalized.

Seeing recent updates from IRCC that they are processing May applications making me lose all hope.

At this point, I have decided to file a writ of Mandamus. My questions are:
  1. Is 1 year delay without any meaningful updates from IRCC sufficient to justify a Mandamus? My application is not complex per IRCC definition. It was complete, including biometrics and medicals on time (before pandemic). I got no requests for additional docs or anything from IRCC.
  2. How long does a typical Mandamus take to finish?
  3. Has anyone in this forum successful gone through the process (or know someone who has) and willing to share their experience? Does anyone have recommendations for a good lawyer in GTA (Toronto area)?
Perhaps some of the senior folks like @legalfalcon @caipsnotes who may have experience with Mandamus can shed some light.

I'm in the same boat too. CEC inland April 11, 2020 AOR and its exactly same status. Mine is not complex either, every time I call, I was told that the visa officer has to pick up my file and make a decision. It's been the same status since Oct (after my bio was updated). The reasons they provide are very lame. Does it really take 6 months for an officer to validate the existing biometrics? just to submit the application on-time and to avoid any delays from the processing, we did all the medicals, collected the PCCs and other documents during the peak pandemic by risking the health. If none of the applications are processed and when you provide an excuse, we can happily accept them. But, when IRCC can process the Q3/Q4 applications, then what is wrong and why Q1/Q2 applications are not processed?

AOR Mar 03, 2020. CEC Inland. Medical expired. No news yet. Me + spouse + 1 dependent.

I spoke to IRCC they said criminality is in progress and security has not started even after one year. Wrote to the MP and they got an update on file which is similar to what was provided by IRCC. MPs can't do more than getting an update on application .

Not sure, how long will it take.

@legalfalcon is there any other remedy? or we just wait? Please suggest :)
I have asked the MP to send a letter to the VO and ask transferring my application to another VO on my behalf. Probably you can ask the same request.

Just got my second set of GCMS notes... Absolutely nothing changed between August 2020 and November 2020. This is so frustrating.

Can someone give me a tip on how to get through to an agent when calling IRCC? I tried yesterday, but they just told me all of the agents were busy and hung up :(

Also, what questions to ask to get at least some sort of concrete answer as to why my application has not progressed at all?

Hi @legalfalcon ,

My current BOWP expires in May, so i'm going to be filing for a new one soon. My predicament is that I changed jobs in August and have only now just realized that I did not update IRCC in relation to my PR application. I already have the documents like my job responsibilities reference letter and pay stubs that i'll need for them to re-asses my eligibility which has already been passed.

Would it be advisable for me to submit this information now via webform before I submit a new BOWP?
Or, would this delay my application even further and I would be ok just applying for new BOWP and include the new job in my work history on there only?

Congratulations! Did you have to do re-medical, or it was just extended? If so, what date did it expire and extended again? Would you mind sharing your VO?

I am really tired of calling them and my agency representative can do nothing for me.
