I'm on a PGWP and i have been working for my current employer for 18months. I am on a permanent/full time position NOC A, can I claim the points for a job offer? under PGWP we are exempt from LMIA
A job offer is valid if your current or future employer:

  • has made a written offer to give you a full-time, non-seasonal job for one year or more if you are accepted as a permanent resident

In Aug 2019 I applied for PR and availed the valid job offer 50 points. My current work permit is valid till Apr 2020 so during eAPR, I submitted the offer of employment which was Initially provided by my employer.

Recently, my employer filed a WP extension and provider a updated offer of employment with the assignment extension for additional 24 months.
hi @SelfishMouse, did the initial offer letter provided by your employer get accepted? Did you end up getting your PR?

Let me clarify since i just met my eligibility requirements

For Closed Work permit for instance you are Inter Company Transfer and you have work permit for 2 years initially you can claim for 50 points for one year of experience - no questions asked here

For Job Offer lets say your ICT employer gives you extension and file for extension of work permit and gives you one year contract and you may end up having 18 months of confirmed job (assuming you get offer early in second year start) you can claim 50 points for Valid Job Offer- Work permit should carry same employer name which it will be

Now here one small catch is that whether they will accept it not - they accepted it for me since my employer explained by association with the company before coming to Canada and value that add to my Company. Also my HR team after consulting with firm legal counsel added the wording- we are giving him one year extension in anticipation of him meeting express entry criteria and getting PR by such date. As per current express entry timelines its six months so i was carrying job offer of one year under extended work permit and 8 months under original work permit - which makes its 20 months.
Also it was added that we will consider extending permanent offer once PR is approved.

Now if IRCC contacted my HR they would have validated this statement by saying that they have history of extending permanent offers once employees get PR and my employer has history of sponsoring employees for PR once they complete 2 years. Its just that i wanted to start early.

But i just got an update that my eligibility has been met
When you say "eligibiliy has been met", was it a message on your profile? and which stream's eligibility did you meet/satisfy, CEC or FSW?

I called CIC yesterday and they were very clear with me that the 1 year after PR requirement is intended to filter out contractual employees. For example there are some employees who have 1 year or two year contracts (this does not mean 2 year work permit as that can be extended). This is what they’re looking to filter out.

The agent asked if I am a full time employee with benefits from the company. When I said yes, she said there shouldn’t be a problem. She asked to provide continuous pay stubs and my T4. Note that she also put me on hold for a few minutes to double check with someone. I plan on submitting my application later this week. Even if my job offer is considered invalid per this wild requirement, I will be above the cut off for CEC.

Thanks for sharing this info. Good luck. You do have the fall back option of subtracting those 50 pts and still be above the cut off (for CEC). Cool.

I am almost on the same boat as you are.

Can you help me on the question. My condition is as below:

1) I am an employee of an MNC back in India. I have been transferred on ICT (Specialized knowledge to Canada), I came in Sep 2019 and should complete 1 year next month.
2) My WP is expiring in Jan 2021, however I am in the process of filing for extension for another 2 years.
My employment letter says, I am an employee of India transeferred to Canada Temporarily for project till the 2023 Jan.(after extension), however it does not mention offer letter is valid for 1 year after PR since that was not the intention of the offer letter , As I am already in Canada.

So can I claim the desired 50 points for Offer letter in sep 2020( after completing 1 year in Canada)? Since 2023 it is implied 1 year after PR.

1) I know you didn't ask this directly but I would wait till I September 2019 to meet the MEC for CEC and then get my ITA.
2) I'm candidly not an expert and your case seems to be different than mine (I was transferred permanently from the US office). I would call CIC and get their input on this. Just so you know what I have done - I have highlighted portions of my offer letter that explicitly call out that I am a full time employee with standard benefits and shown that there is no contract mentioned anywhere on my offer. I have not submitted as yet so don't know how it will be received. However, given my conversation with the person on the phone, I am more confident about the submission. Also, even if lose the 50 points for some wild reason, I am above the cut off CRS score.

My Secondment (Letter of Assignment) has temporary assignment stated since I am on a temp visa, though I am a full time employee of the Indian firm.
I have lost a lot of points due to age, hence I would need these 50 points.

One difference is that (I don't know what is "Secondment (Letter of Assignment)") the phrase "temporary" is used in my work permit application which technically is a temporary 2 yr work permit (although it can be renewed).

Actually inland applications have picked up speed.
Especially CEC. Today they updated on their website.

We all are in the same boat. I applied 0ct 20. Fingers crossed for 50 points...
